FEBRUARY 209 1973 <br /> The meeting was called to order by Mayor Carlson at 7:15 PM. Roll was called: Carlson, <br /> LaValle, Leroux, Lease Present. Bjorum absent. <br /> The claims for payment were reviewed and Don Lease disagreed with the Village paying <br /> $25.00 toward sending a child for School Safety Patrol Instruction. Motion made by <br /> LaValle,seconded by Leroux to pay American Legion Post #620 $25.00 for School Safety <br /> Patrol, Carlson, LaValle Leroux for Lease Opposed. Motion carried. <br /> Motion made by Leroux, seconded by LaValle to accept claims as presented. Motion carried. <br /> The Minutes of February 5th were reviewed and Paragraph #1, Page #4 was corrected to read <br /> that "It is provided by ordinance that Village back up Building Inspector if he is doing <br /> his job properly." Paragraph #8 Page #4 was corrected to read, "Regarding Clyde Rehbein, <br /> Attorney Johnson had prepared two complaint forms to be given to Crever to take care of <br /> by submission to the County Court." Minutes approved after the corrections. <br /> Regarding the Indykiewicz Mining Permit, Attorney Johnson suggested adding to Condition <br /> #5 that as an alternative to a performance bond, a licensed bond be filed. Motion made by <br /> LaValle, seconded by Leroux to amend Condition # 5 of the Indykiewicz Mining Permit to include <br /> " or a licensed bond in the sum of $10,000.00 be filed." Motion carried. <br /> Motion made by LaValle, seconded by Leroux to grant Special Use Permit to George Indykiewicz <br /> to mine black dirt, top soil and fill, and the said permit to include legal description <br /> of land involved. Motion carried. <br /> Motion made by LaValle, seconded by Leroux to grant Mining Permit to George Indykiewicz <br /> for one year. Motion carried. It was noted that Mr. Indykiewicz paid a $300.00 fee <br /> before leaving the meeting. <br /> Mr. Phil Hobrought of Lyman Freightways appeared before Council asking for a resolution <br /> for the use of twin trailers in Minnesota. As a bill to this effect is to be brought <br /> before the State Legislature in the near.future, a committee from Hyman has been <br /> approaching all County Seats in Minnesota. The Washington County Highway Engineer has <br /> already sent a resolution approving this measure to the State. Marvi u LaValle <br /> suggested Mr. Hobrough send the (buncil copies of bills which have been drafted up <br /> for the legislature and Mr. Hobrough agreed. <br /> Motion made by LaValle, seconded by Lease to table this matter until the March 5th <br /> Council Meeting. Motion carried. <br /> Public Hearing opened at 8:00 PM for application for Mining Permit by Thomas E. LaValle <br /> dba LaValle Excavating Co. 5564 152nd St. No., Hugo, Minnesota. <br /> Mayor Carlson read the provisions of the permit, and a letter from LaValle to the <br /> Council was read stating provisions he would like changed. LaValle wanted the bond <br /> lowered from $15,000.00 to $10000.009 wanted Saturday hauling included, and wanted <br /> the inspection fee lowered. Engineer Kuusisto said since LaValle is a Hugo resident, perhaps <br /> this should be considered.. in reviewing the provisions. Mr. John Gressman from the <br /> audience spoke out that he was in favor of Saturday hauling, as most people have Saturday <br /> to order gravel for their purposes. Public Hearing closed at 8:20 PM. Discussion was <br /> then held by the Council and Lease inquired as to the difference between this permit and <br /> the Fisaher Mining Permit, Mr. Kuusisto stated that as Fischer had a much larger operation <br /> and was difficult to communicate with, their bond was set at $25000.00 <br /> Marvin LaValle said he would like Section 9D of Tom LaVAlle's application deleted, as <br /> Tom shouldn't have to maintain a road if he wasn't hauling on it. Motion made by Carlson, <br /> seconded by Lease to amend Item #2 of the Mining Permit adding to line #3 following the <br /> quotation marks, Application for Mining Permit with the exception of Item 9D, and also <br /> amend the permit to delete Item #6. Carlson, Leroux, and Lease for, Marvin LaValle <br /> abstained. Motion carried. <br />
