K_indsvater paid the $$15.00 for the Variance Application. <br /> MOTION: LaValle made motion, Leroux seconded to grant a <br /> Variance to the White Bear Rod & Gun Club for a ten month <br /> tree planting, Item #2 of their Special Use Permit, <br /> extension to July 1 , 1976. <br /> VOTING FOR: Lease, LaValle, Leroux. <br /> VOTING AGAINST: Schletty <br /> ABSTAIN: Smith <br /> MOTION CARRIED <br /> DISCUSSION: Smith asked attorney Johnson if it was legal to <br /> grant an extension of time even after the deadline <br /> date had been reached. In his opinion the Permit <br /> was null and void as the planting date of June 1 , <br /> 1975 had not been met. <br /> Schletty stated that the planting of Lombardy <br /> Poplar trees had not met the requirements. <br /> LaV lle stated he heard the Club will install a <br /> lead recovery program at their earliest financial <br /> convenience. As far as he was concerned the Club <br /> had met all regulations with the exception of the <br /> reimbursement for legal, engineerin and the <br /> enviromental study at the costs of 3,413.00. <br /> Two Certificate of Occupancy are to be issued one for <br /> the structure and one for the trap and skeet house. <br /> Building Inspector could issue a certificate for a portio: <br /> only, listing facilities the Club could or could not use. <br /> MOTION: LaValle made motion, Leroux seconded to renew <br /> the White Bear Rod & Gun Club Special Use Permit <br /> subject to payment of 13,413.00 which is in regard <br /> to Conditions #21 and #24 of the Special Use Permit. <br /> VOTING FOR: LaValle, Lease, Leroux <br /> VOTING AGAINST: Smith and Schletty. <br /> MOTION CARRIED <br /> Attorney Edward Zimmermann representing HELP said there <br /> was no record of a Variance being granted extending the <br /> time of tree planting to a certain date and that this <br /> condition had not been met, the Special Use Permit should <br /> become null and void in its entirety. Can this permit <br /> be renewed or a new Special Use Permit be sought with a <br /> new public hearing. Attorney stated the City of Hugo <br /> has a responsibility bf land use. Fencing condition had not been <br /> met. <br />
