SEQ. <br /> The City Council for the City of Hugo, Washington County, <br /> Minnesota and the Town Board of Supervisors of the Town of May, <br /> Washington County, Minnesota hereby ordain as follows : <br /> Section 1 . Purpose. <br /> This Ordinance is adopted to establish a storm sewer <br /> improvement tax district within the meaning of Minnesota Statute <br /> §444 . 16 et . seq. The district is established in order to authorize <br /> and fund a study and any necessary improvements to solve a problem <br /> with flooding existing in an area which overlaps the common border <br /> between the City of Hugo and the Town of May. This flooding has <br /> caused property damage to citizens of the two municipalities and <br /> has endangered and made impassible public roads . <br /> The governing bodies of the City and Town have determined that <br /> it is in the best interests of their respective municipalities to <br /> set up a method to insure that work is done to the benefit of the <br /> residents of the area and that the costs are fairly and equitably <br /> apportioned among those properties contributing water to the <br /> flooding problem. <br /> Section 2 . Authority. <br /> The City and Town have adopted this Ordinance pursuant to the <br /> provisions of Minnesota Statute §444 . 16 et . sect. and pursuant to <br /> the terms of the Joint '`ewers Agreement adopted by the City and <br /> Town on the ..,, ..;v.--.4day of ,,. , 19 96 . <br /> Ir <br /> Section 3 . Description of L-1. 4" . <br /> Pursuantto Minnesota Statute §444 . 17, the territory or area <br /> included within the storm sewer improvement district is described <br /> with particularity on the attached Exhibit A, said land is <br /> hereinafter referred to herein as the "Subwatershed.
