SEQ. The City Council for the City of Hugo, Washington County, Minnesota and the Town Board of Supervisors of the Town of May, Washington County, Minnesota hereby ordain as follows : Section 1 . Purpose. This Ordinance is adopted to establish a storm sewer improvement tax district within the meaning of Minnesota Statute §444 . 16 et . seq. The district is established in order to authorize and fund a study and any necessary improvements to solve a problem with flooding existing in an area which overlaps the common border between the City of Hugo and the Town of May. This flooding has caused property damage to citizens of the two municipalities and has endangered and made impassible public roads . The governing bodies of the City and Town have determined that it is in the best interests of their respective municipalities to set up a method to insure that work is done to the benefit of the residents of the area and that the costs are fairly and equitably apportioned among those properties contributing water to the flooding problem. Section 2 . Authority. The City and Town have adopted this Ordinance pursuant to the provisions of Minnesota Statute §444 . 16 et . sect. and pursuant to the terms of the Joint '`ewers Agreement adopted by the City and Town on the ..,, ..;v.--.4day of ,,. , 19 96 .
