Section 4 . Name of District. The storm sewer improvement district created herein shall hereinafter be referred to as the "Hugo/May Joint Storm Sewer Improvement Tax District No. 1 . " Section 5 . Ordering Study. Stud . The City Council for the City of Hugo and the Town Board of the Town of May hereby authorize and direct the City of Hugo to authorize its engineer to conduct a storm sewer improvement study Y to determine what storm sewer project, improvement ' if any, should P P be undertaken to solve the problem with the flooding referred to herein. The report shall advise the City and the Town in a preliminary way as to: a. whether the proposed improvement is feasible; b. whether it should be made as proposed or in connection with some other improvements; c . the estimated cost of the improvement; and, d. a proposed method for assessing the costs of the study and any proposed improvement projects upon the lands within the Subwatershed. Upon the City and Town' s receipt of the preliminary study herein, the City and Town shall meet in a joint session to discuss said report and determine whether or not plans and specifications should. be prepared by the engineer. At said meeting, the municipalities shall also discuss such other issues as are relevant to proper determination of the cause . Section 6 . Filings . The City Clerk of the City of Hugo and the Town Clerk of the Town of May are hereby directed to file a certified copy of this Ordinance and a certified copy of the Joint Powers Agreement referenced herein with the County Auditor and a separate copy with the County Recorder pursuant to the statutory mandate found in Minnesota Statute §444 . 17 . Section 7 . Effective Date. This Ordinance shall be in full force and effect from and after its passage of publication according to law. Whereupon said Ordinance was declared passed and adopted by the City of Hugo, Washington County, Minnesota this 8th day of April , 19 96 ; and,
