. . <br /> ( c) Where a permit is issued for the construction of <br /> structures, sewage treatment systems, and driveways, and the <br /> grading , filling or excavation of material is necessary for <br /> the construction of the improvement, the permit for such <br /> grading , filling , or excavation shall be incidental to the <br /> construction permit . <br /> (2) Permit.. Stpndarlqs_. <br /> (a) Where any grading , filling , or excavation impacts a <br /> state or federally protected wetland , a copy of a valid <br /> permit from the appropriate regulatory body for such work <br /> shall be filed with the City Building Official prior to the <br /> issuance of a construction permit. <br /> ( b) Any alterations below the ordinary high water level of <br /> public waters shall first be authorized by the Commissioner <br /> of the Department of Natural Resources under Minnesota <br /> Statutes, Section 103G.245. <br /> ( c) Alterations to topography may only be allowed if they <br /> are accessory to a permitted or conditional use of the <br /> property , and do not adversely affect adjacent or nearby <br /> properties. <br /> (d ) Placement of natural rock riprap, including associated <br /> grading of shoreline and placement of a filter blanket, shall <br /> only be permitted where the finished slope does not exceed <br /> three feet horizontal to one foot vertical , the landward <br /> extent of the riprap is within ten feet of the ordinary high <br /> water level , and the height of the riprap above the ordinary <br /> high water level does not exceed three feet . <br /> (e) Excavations intended to connect water-oriented <br /> activities, such as boat slips, canals, lagoons, and harbors <br /> shall only be permitted after approval by the Commissioner of <br /> the Department of Natural Resources. <br /> (3) ErosionControl <br /> ( a) Any person grading , filling , or excavating within a <br /> shoreland area shall take adequate measures to trap and <br /> retain sediments and pollutants from entering the protected <br /> water body , store runoff to prevent or reduce flood damage, <br /> protect fish and wildlife habitat, preserve the recreational <br /> use of the water body , stabilize the shoreline or bank , and <br /> protect areas of historic or environmental importance. <br /> ( b) Any person applying for a construction permit , grading <br /> or filling permit, conditional use permit, variance, or <br /> subdivision approval impacting a shoreland area shall provide <br /> the building official an erosion control plan prior to the <br /> issuance of any permit or approval .
