. <br /> . � <br /> �. ,. <br /> . <br /> Subd . B. Alteration of Vegetation . Removal or alteration of <br /> vegetation , except for agricultural and forest management uses, as <br /> regulated in Section 320-56, is allowed subject to the following <br /> conditions: <br /> 1 . Intensive clearing of vegetation within shore and bluff <br /> impact zones is not allowed . Limited clearing of trees, <br /> shrubs, cutting , pruning and of trees to provide view to the <br /> water from the principal dwelling site and to accommodate the <br /> placement of stairways and landings, picnic areas, access <br /> paths, livestock watering areas, beach and watercraft access <br /> areas, and permitted water-oriented accessory structures or <br /> facilities provided that: <br /> (a) Clearing of vegetation shall be limited as much as <br /> possible in accordance with the policies established in <br /> Section 320-50, Subd . B. No vegetation shall be removed <br /> which would lead to erosion , bank slumping , or change to <br /> the topography of shoreland or public waters, except <br /> through variance granted by the City Council . <br /> ( b) The screening of structures, vehicles, or other <br /> facilities, as viewed from the water , assuming summer <br /> leaf-on conditions is not substantially reduced . <br /> ( c) Existing shading of water surfaces is preserved <br /> along rivers. <br /> (d ) Minor removal of trees, limbs, or branches that are <br /> dead , diseased , or pose safety hazards is permitted <br /> without permit. Where removal of the dead or diseased <br /> vegetation would lead to erosion , bank slumping , or <br /> change to the topography of shoreland or public waters, <br /> such removal will be allowed by permit given an erosion <br /> and sedimentation plan approved by the regulating <br /> watershed management organization , and a vegetative <br /> restoration plan to restore screening approved by the <br /> City ' s Building Official . <br /> 2. Intensive clearing of vegetation within shoreland boundaries, <br /> . <br /> but out side of shore and bluff impact zones, may be <br /> permitted as a conditional use given an erosion control and <br /> , <br /> sedimentation plan is approved by the regulating water <br /> management organization or district . <br /> Subd . C. Topographic alterations/Grading and Filling <br /> 1 . Permits required . <br /> (a) Permits are required for the movement or fill of ten <br /> ( 10) or more cubic yards of material on steep slopes or <br /> within shore or bluff impact zones. <br /> ( b) Permits are required for the movement or fill of more <br /> than 50 cubic yards of material in shoreland areas other than <br /> steep slopes, or shore, or bluff impact zones . <br /> 15 <br />
