Where, in a group of two or more contiguous lots under <br /> the same ownership, one or more of the individual lots does not <br /> meet the requirements of Section 320-49 of this ordinance , none of <br /> the contiguous lots shall be developed or sold as separate parcels <br /> until the parcels are combined so as to meet the requirements of <br /> of this ordinance to the greatest extent possible. <br /> 320-60 ADDITIONS AND EXPANSIONS TO NONCONFORMING STRUCTURES <br /> Subd . A. All additions or expansions to the outside dimensions of <br /> an existing nonconforming structure must meet the setback , height , <br /> and other requirements of Section 320-49 of this ordinance, except <br /> as authorized by a variance pursuant to Section 320-46. <br /> Subd . B. Deck additions may be allowed without a variance to a <br /> structure not meeting the required setback from the ordinary high <br /> water level if all of the following criteria are met: <br /> 1 . The structure existed on the date the structure set backs were <br /> established . <br /> 2 . No reasonable location for a deck meeting or exceeding the <br /> existing ordinary high water level setback of the structure <br /> exists. <br /> 3. The deck encroachment toward the ordinary high water level <br /> does not exceed 15 percent of the existing setback of the <br /> structure from the ordinary high water level or does not encroach <br /> closer than 30 feet, whichever is more restrictive <br /> 4 . The deck is constructed of wood , and is not roofed or <br /> screened . <br />, 320-61 NONCONFORMING SEWAGE TREATMENT SYSTEMS <br /> Subd . A. A sewage treatment system not meeting the requirements <br /> of Hugo City Code, Chapter 263, or Section 320-49 of this <br /> ordinance, shall be upgraded to meet these requirements prior to <br /> the issuance of any permit or variance for the property . A sewage <br /> treatment system shall not be considered nonconforming if its only <br /> deficiency is improper setback from the ordinary high water level . � <br /> Subd . B . Any individual sewage treatment system located in a <br /> shoreland area which uses a cesspool , leaching pit, seepage pit, <br /> or other deep disposal system, or with less soil treatment area <br /> separation above ground water than is specified in Chapter 263 or <br /> which has failed , shall be brought into compliance with city <br /> ordinance by December 31 , 1996. <br /> 320-62 SUBDIVISION AND PLATTING OF PROPERTY <br /> Subd . A. Each lot created in a shoreland area, including planned <br /> unit developments, must be suitable in its natural state for its <br /> proposed use with minimal alteration to its topography and <br /> vegetation . In determining the suitability for a proposed use the <br /> City Council shall consider: <br /> 22 <br />
