Deed restrictions, covenants, permanent easements, or <br /> other equally effective and permanent means must be provided <br /> to ensure long-term preservation and maintenance of open <br /> space. The instruments must include all of the following <br /> protections: <br /> ( a) Commercial uses are prohibited ( for residential <br /> PUD' s) . <br /> ( b) Vegetation and topographic alterations other than <br /> routine maintenance are prohibited . <br /> ( c) Construction of additional buildings, storage of <br /> vehicles or equipment, and all forms of accessory <br /> storage are prohibited . <br /> (d ) Uncontrolled beaching of watercraft is prohibited . <br /> 3. All residential planned unit developments must include <br /> the establishment of a home owners association with the <br /> following features, unless other acceptable and adequate <br /> controls are available through city regulation or ordinance <br /> to accomplish the same goals: <br /> (a) Membership must be mandatory for each dwelling unit <br /> or site purchaser and any successive purchaser . <br /> ( b) Each member must pay a pro rata share of the <br /> associations' s expenses, and unpaid assessments can <br /> become liens on units or sites. <br /> ( c) Assessments must be adjustable to accommodate <br /> changing conditions. <br /> (d ) The association must be responsible for insurance, <br /> taxes, and maintenance of all commonly owned property <br /> and facilities. <br /> Subd . E . OPEN SPACE REQUIREMENTS <br /> 1 . At least 50 percent of the total project area must be <br /> preserved as open space. <br /> 2 . Dwelling units or sites, road rights-of way , or land <br /> covered by road surfaces, and parking areas or structures, <br /> shall not be considered open space in the computation of this <br /> requirement . Boat launching sites, and their associated <br /> parking areas may be included as open space if their <br /> principle function and use is to support recreational use of <br /> the water body , and sufficient additional parking is provided <br /> to meet the needs of of the residential or commercial use of <br /> the property . <br /> 28 <br />
