Areas with physical characteristics unsuitable for <br /> development in their natural state, and areas containing <br /> significant historic sites or unplatted cemeteries, must be <br /> set aside as open space. Such areas may be used to fulfill <br /> the open space requirements of the development . <br /> 4 . Outdoor recreational facilities, such as play fields, <br /> tennis courts, and swimming pools, may be used to fulfill the <br /> open space requirements of the development, if they require <br /> no mechanical or motor driven equipment for their usual and <br /> normal use (except that swimming pools may have normal heat <br /> and filtration equipment) . <br /> 5. Subsurface sewage treatment facilities, including mound <br /> systems as defined in Chapter 263, may be located in open <br /> space areas if the space is restricted to avoid adverse <br /> impact on the systems. <br /> 6 . Commercial facilities or uses shall not be included as <br /> fulfillment of the open space requirement of any development . <br /> 7 . Areas used to fulfill the open space requirement shall be <br /> subject to restrictive deed covenants, permanent easements, <br /> public dedication and acceptance, or other equally effective <br /> and permanent means to protect their topography , vegetation <br /> allowable uses, and historical significance in perpetuity . <br /> B. The shore impact zone, based on normal structure <br /> setbacks, shall be included as open space. At least 70 <br /> percent of the shore impact zone within residential PUD' s, <br /> and at least 50 percent of the shore impact zone within <br /> commercial PUD' s shall be preserved in its natural or <br /> existing state. <br /> Subd . F . EROSION CONTROL AND STORMWATER MANAGEMENT <br /> 1 . Approval of all planned unit developments in shoreland <br /> areas shall be conditioned upon the preparation and approval <br /> of a stormwater management plan meeting the following <br /> requirements: <br /> ( a) During site development and construction , erosion <br /> shall be minimized by limiting the amount and length of <br /> time of bare ground exposure. Temporary ground covers, <br /> sediment entrapment facilities, vegetative buffer <br /> strips, or other appropriate technologies must be used <br /> to protect ( in so far as possible) sedimentation of <br /> surface waters and protected wetlands. <br /> 29 <br />
