The Grantee ' s technical ability, financial condition, legal <br /> qualifications, and character were considered and approved in <br /> a full public proceeding after due notice and a reasonable <br /> opportunity to be heard. <br /> B. Grantee ' s plans for constructing and operating the System <br /> were considered and found adequate and feasible in a full <br /> public proceeding after due notice and a reasonable <br /> opportunity to be heard; <br /> C. The franchise granted to Grantee by the City complies with <br /> the existing applicable Minnesota Statutes , Federal laws and <br /> regulations; and <br /> D. The Franchise granted to Grantee is nonexclusive . <br /> ARTICLE I_ <br /> SHORT TITLE AND DEFINITIONS <br /> SECTION 1 . SHORT TITLE <br /> This Ordinance shall be known and cited as the Cable <br /> Communications Ordinance. <br /> SECTION 2 . DEFINITIONS <br /> For the purpose of the Franchise, the following terms , <br /> phrases , words and their derivations shall have the meaning given <br /> herein. When not inconsistent with the context, words used in the <br /> present tense include the future, words in the plural number <br /> include the singular number, and words in the singular number <br /> include the plural number. The words "shall " and "will " are <br /> mandatory and "may" is permissive. Words not defined shall be <br /> given their common and ordinary meaning. <br /> 2 <br />
