220-3. POSTING OF HOURS. The City may cause the limitation of hours <br /> of usage to be posted on each or any public park, but the failure to so post, <br /> or the failure to replace defaced or damaged postings, shall not limit the <br /> scope or applicability of this regulation. <br /> 220-4. SPECIAL PERMIT. Upon application in writing by an individual <br /> or organization made to the City Council of the City of Hugo, prior to a <br /> planned event, the City Council may in its sole discretion grant a Special <br /> Permit for more than one (1) day extension of hours for use by that indi- <br /> vidual or organization. The City Council may condition the granting of any <br /> such Special Permit upon specified conditions including, but not limited <br /> to, posting such financial security to protect against damage or clean-up <br /> as may be appropriate; placement of sanitary and/or refuse collection faci- <br /> lities; provision for supervisory or security personnel; clean-up require- <br /> ments; insurance; or such other conditions as may be deemed necessary in <br /> the circumstances. The Mayor, Acting Mayor, or Council member designated <br /> as Parks Commissioner, may issue a permit for one (1) day only subject to <br /> all other conditions of this paragraph being met. There shall be no fee <br /> for a Special Permit. <br /> Upon rejection of any application for a Special Permit for any <br /> applicant, that applicant shall be prohibited from making re-application <br /> for a similar Special Permit for a period of three (3) months after the <br /> date of such rejection. <br /> 220-5. PENALTIES. Any person who shall violate the usage regu- <br /> lations herein set forth relating to public parks, shall upon conviction <br /> thereof be guilty of a misdemeanor, and shall be punishable therefore <br /> according to law, plus the cost of prosecution. <br /> 220-6. SEPARABILITY. Every section, provision or part of this <br /> Chapter is declared separable from every other section, part of provision; <br /> and if any section, part of provision hereof shall be held invalid, it shall <br /> not affect any other section, part or provision. <br /> 220-7. EFFECTIVE DATE. This regulation shall be effective from <br /> and after its date of adoption and publication according to law. <br /> ADOPTED AND PASSED THIS 3'�4 DAY OF . , 1984. <br /> /J.
