82. 12 ACCESS CONTROL - DUAL DRIVEWAYS. The area between <br /> driveways for the same property shall be so con- <br /> structed or improved that traffic on the highway and <br /> on the property will in fact be separated. In plat- <br /> ted areas where a sidewalk extends to the property line, <br /> a curb is required at least four (4) inches wide and <br /> four (4) inches high above the sidewalk along the inside <br /> edge of the lot line and extending for at least the <br /> full distance of the sidewalk. Where no sidewalk ex- <br /> ists, this traffic separation may be obtained by the <br /> planting of a hedge or the construction of an island. <br /> Such an island or planting can only be placed on the <br /> right-of-way under permit from the City. <br /> 82. 13 VARIANCE. A variance from the standards set forth <br /> in this regulation may be allowed by the City Council <br /> when the variance will facilitate the safe, efficient <br /> use of the property for a lawful purpose and will not <br /> interfere with the construction, maintenance or safe <br /> and efficient use of the street and its appurtenances <br /> by the public. <br /> 82.14 EXISTING DRIVEWAYS. Any existing driveway that does not <br /> comply with the provisions of the regulations herein <br /> set forth and causes damage to the public right-of-way <br /> due to erosion, or constitutes a traffic hazard, shall <br /> be required to be brought into compliance. The owner <br /> of the property having the non-complying driveway <br /> shall be notified by certified mail directed to the <br /> property address, by the City to appear at a meeting <br /> of the City Council to review the situation. The City <br /> shall require the City Engineer or the Building In- <br /> spector to inspect the driveway and present a report <br /> on or before the date of Council meeting at which <br /> the matter is to be discussed with the property owner, <br /> as specified in the notice, or at such other date as <br /> may be agreed upon between the City and the owner. If <br /> after hearing the reports and evidence, the City Coun- <br /> cil determines that the driveway does not comply and is <br /> causing damage or is a traffic hazard, the driveway <br /> shall on motion passed by a majority of the Council <br /> be declared a nuisance and the owner directed to obtain <br /> a driveway permit for alteration and correction of the <br /> condition, and make such corrections or alterations <br /> within a time to be established by the City, the time <br /> being not less than thirty (30) days, nor more than <br /> one-hundred eighty (180) days.
