30-9. IDENTIFICATION TAGS. The City shall provide <br />identification tags that may be purchased by resi- <br />dents of the City for identifing their dogs as <br />to ownership, and shall maintain records of the <br />owner's names, and last -known address, and a descrip- <br />tion of the dog, for notification purposes in the <br />event any dog bearing an identification tag is im- <br />pounded. The charge for such identification tags <br />shall be established by Resolution of the City Council <br />from time to time. The issuance of Identification <br />Tags is for the benefit of the public and as a <br />means to assist dog owners in training or locating <br />their dogs, and shall not impose any greater burden <br />on the City or the Animal Warden regarding notifica- <br />tion than would otherwise be required under this <br />Ordinance, and shall not give any owners any superior <br />right by reason of havng purchased such Identification <br />Tag. <br />30-10. KILLING DOGS PROHIBITED, EXCEPT IN CERTAIN CASES. <br />It shall be unlawful for anyone to intentionally <br />injure or kill any dog of another, except an owner <br />or caretaker may kill any dog found chasing, injur- <br />ing, or worrying sheep or other livestock or poultry <br />owned by him or in his care, on lands or premises <br />controlled by him; or except any person may kill any <br />dog that attacks while he is peacefully walking or <br />riding and the dog is not on the premises of its <br />owner; or except as otherwise may be permitted by <br />Minnesota Statutes. <br />30-11. PENALTIES. Any person who shall violate any of the <br />terms and provisions of this Ordinance shall be guilty <br />of a misdemeanor and, upon conviction, shall be punish- <br />ed by a fine of not more than $300.00 or by imprison- <br />ment for not to exceed ninety (90) days, or both. <br />30-12. VALIDITY. The invalidity of any part of the <br />Ordinance as declared by a Court of competent <br />jurisdiction shall not affect the validity of <br />the remainder thereof. <br />30-13. EFFECTIVE DATE. This Ordinance shall take effect <br />and be in force from and after its passage and <br />publication. <br />
