30-9. IDENTIFICATION TAGS. The City shall provide identification tags that may be purchased by resi- dents of the City for identifing their dogs as to ownership, and shall maintain records of the owner's names, and last -known address, and a descrip- tion of the dog, for notification purposes in the event any dog bearing an identification tag is im- pounded. The charge for such identification tags shall be established by Resolution of the City Council from time to time. The issuance of Identification Tags is for the benefit of the public and as a means to assist dog owners in training or locating their dogs, and shall not impose any greater burden on the City or the Animal Warden regarding notifica- tion than would otherwise be required under this Ordinance, and shall not give any owners any superior right by reason of havng purchased such Identification Tag. 30-10. KILLING DOGS PROHIBITED, EXCEPT IN CERTAIN CASES. It shall be unlawful for anyone to intentionally injure or kill any dog of another, except an owner or caretaker may kill any dog found chasing, injur- ing, or worrying sheep or other livestock or poultry owned by him or in his care, on lands or premises controlled by him; or except any person may kill any dog that attacks while he is peacefully walking or riding and the dog is not on the premises of its owner; or except as otherwise may be permitted by Minnesota Statutes. 30-11. PENALTIES. Any person who shall violate any of the terms and provisions of this Ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punish- ed by a fine of not more than $300.00 or by imprison- ment for not to exceed ninety (90) days, or both. 30-12. VALIDITY. The invalidity of any part of the Ordinance as declared by a Court of competent jurisdiction shall not affect the validity of the remainder thereof. 30-13. EFFECTIVE DATE. This Ordinance shall take effect and be in force from and after its passage and publication.
