JUNE 7, 1976 59 <br /> MOTION: Lease made motion, seconded by LaValle, to table the matter <br /> of the Indykiewicz mining permit until the meeting of <br /> June 21 , at which time Mr. Indykiewicz is requested to appear. <br /> VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> MOTION: LaValle made motion, seconded by Smith, to table the matters <br /> of renewal of mining permits for Barton and Fischer until <br /> the proper information is furnished. <br /> VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> 5 ,3 DEZIEDL - LAND DIVISION <br /> MOTION: LaValle made motion, seconded by Smith, to approve land <br /> division for Vernon DeZiel for Tracts A thru G, Government <br /> Lot 2, Section 16, T31N, R21 , Washington County, based <br /> on the certificate of survey by Don Hult, dated August <br /> 2, 1974. <br /> VOTING FOR: Lease, LaValle, and Smith <br /> VOTING NO: Leroux and Schletty <br /> MOTION CARRIED <br /> 5.4 VAIL RE: DRAINAGE <br /> MOTION: LaValle made motion, seconded by Leroux, to place matter <br /> of blacktopping Hyde Avenue on the agenda for the June <br /> 21 , 1976 meeting. <br /> VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> MOTION: Lease made motion, seconded by LaValle, to write Richard <br /> Vail a letter asking him to appear at the June 21st council <br /> meeting and be prepared to discuss with the Council the <br /> flood problem in Evergreen Hills and his anticipated sch- <br /> edule for alleviating the problem. Copies to City Engineer <br /> and Rice Creek Watershed District. <br /> VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith <br /> MOTION CARRIED <br /> 5.5 HORTON - SPECIAL USE PERMIT <br /> Attorney advises lawsuit taken off the court calendar - discussed <br /> the terms of settlement and terms that would be agreeable to both <br /> the City and the applicant. Condition #8 is being questioned but <br /> everything else is in agreement. On site drainage or ponding has <br /> been discussed and Horton is looking into it. <br /> MOTION: Lease made motion, seconded by Smith to tenatively approve <br /> the Special Use Permit for Norm Horton, subject to receipt <br /> of the bond by the city; also tenative on the agreement <br /> to dismiss the lawsuit between the City of Hugo and Norm <br /> Horton Sr; striking the first sentence of Item #8, but <br /> leaving the second sentence. Clerk to check the payment <br /> of the permit fee. <br /> VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. <br /> MOTION CARRIED <br /> STOLTZMAN DUMP <br /> Mrs. Laura Stoltzman appeared - would like letter from City of <br /> Hugo stating City has no objection to their operating a demolation <br /> dump - they need approval from City of Hugo, Washington County, <br /> Rice Creek Watershed District and PCA. Lease said they can no longer <br /> have a land fill operation - Stoltzman said they are seeking permission <br /> for demolition dump only - no garbage allowed - Lease said he has <br /> no objection to the transfer part of the operation. <br /> MOTION: LaValle made motion, seconded by Lease to write a letter <br /> to Mr. Wolters of PCA, and ask what they want from the <br /> City of Hugo to try to resolve the Ltoltzman situation. <br />
