DECEMBER 6, 1976 3 ti 3 <br /> MOTION: LaValle made motion, seconded by Leraux, that emergency <br /> alarm should continue to be sounded at 12 :00 noon and <br /> 10:00 P.M. <br /> VOTING FOR: Lease, Leroux, and LaValle <br /> AGAINST: Smith and Schletty <br /> MOTION CARRIED <br /> Recess 9:28 Reconvened 9:43 <br /> MOTION: LaValle made motion, seconded by Leroux, to give <br /> authority to George Koland to remodel clerk's office <br /> at a cost of $200.00. <br /> VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux <br /> MOTION CARRIED <br /> An unemployment claim in the amunt of $1969.00 was received for <br /> Mr. Lelle. If city is liable, we have to pay it. Money to come <br /> from police budget. <br /> Irene Leroux requested that city clerk send a letter to Metropolitan <br /> Council (Mr. John Boland) stating that the new Public Works 13-j _huotE <br /> will have no effect on the City of Hugo. <br /> Vail blacktopping bond is to be release. Bonding company to be <br /> notified. <br /> 8.0 Unfinished Business <br /> 8.1 Vail removing dike on Brevig Property <br /> Mr. Richard Vail appeared and stated that he put the dike in per <br /> instruction from the Rice Creek Water Shed. He stated he has no <br /> intention of removing the dike. LaValle stated the dike should be <br /> on the easement and not on private property. City is aware of problem: <br /> Rice Creek has nothing on file as far as issuing a permit for in— <br /> stallation of the dike. It would not be economical to move the <br /> dike at this time. <br /> Vail — If the government told me where to put the dike, they should <br /> remove it. <br /> LaValle — The dike is now being used as a road. <br /> Lease — asked City Attorney, Mr. Johnson, what to do now. <br /> Johnson — If the dike is on private property, it is a matter between <br /> the property owner and the developer. The city could block the <br /> right—of—way from being used as a road. <br /> Kuusisto — Matter was discussed by the City Council. Council was <br /> to make suggestions to Rice Creek. <br /> Johnson —One alternative would be to negotiate with land owner <br /> to m've easement. <br /> LaValle — Will check further in our minutes, and with Rice Creek. <br /> Nothing can be done now. <br /> Brevig — would like to sell back two acres of property. The dike <br /> has defaced and devalued the back property. Lost rental in my <br /> garage, and encourages snowmobiling. Brought this matter up three <br /> months ago, and nothing has been done since. <br />
