VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld. MOTION CARRIED <br /> tj City Attorney, Charles Johnson, submitted a written supplemental report stat- <br /> ing the pending criminal prosecutions. <br /> Mr. Johnson has been in contact with Sarah Mardell in conjunction with the <br /> Lars Danielson vacation of easement. Washington County has vacated the ease- <br /> ment by a Resolution. Ms. Mardell is asking that the matter of the street <br /> vacating be set for public hearing. Purchaser would pay for publication, but <br /> has not agreed to pay for any engineering fees that may be incurred. Mayor <br /> LaValle requested City Attorney, Charles Johnson, and City Engineer, Howard <br /> Kuusisto, to submit an estimate as to the cost of the procedure prior to the <br /> meeting of February 7, 1977. Charles Johnson stated that the city would be <br /> asking for a contribution for the costs from the purchaser. According to <br /> Spitzer, it would be difficult to get a public hearing in February. A hear- <br /> ing in March would be more feasible. Schletty asked Kuusisto if he would <br /> like to see us keep the right-of-way. Kuusisto stated that he would like to <br /> take a second look at the matter. Schletty stated that this area was the <br /> highest point in Hugo, and might be able to be used for a water tower. Mr. <br /> Johnson said this was something that should be made part of the public hear- <br /> ing along with other uses of the property. Matter to be added to the <br /> Agenda of February 7, 1977. <br /> The Mutual Aid Agreement with Forest Lake was discussed. Mr. Olsen, Fire <br /> Chief, stated that the Fire Department would be covered for liability any- <br /> where in the United States, Mr. Johnson said the authorization would have <br /> to come from the City Council for equipment to leave the City. Once the City <br /> has approved the policy for emergency calls by resolution, it would not have <br /> to be approved annually. Mr. Johnson's main concern is that equipment is co- <br /> vered for loss outside the city, not only for Hugo, but Forest Lake's equip- <br /> ment in. Hugo. Mayor stated that Hugo is a member of Capital City Regional, <br /> and Mr. Johnson wanted to know if there was a written agreement. Mr. Olson <br /> said it was written in the by-laws, and he would send Mr. Johnson a set of <br /> the by-laws. <br /> 8.0 . ) NEW BUSINESS <br /> 8.2 Recommendation to Plannin€, Commission Regarding the Rezoning Request <br /> of the Bald Eagle Sportsmen Club <br /> The Sportsmen Club wants the City to make a zone for them (commercial-recreat- <br /> ional). If a special zone was created for their use, they would not need a <br /> Special Use Permit. Spitzer stated that we could establish the zone but not <br /> have permitted uses. Therefore, a Special Use Permit would be required for <br /> all uses. The point is, just by establishing the zone that they are request <br /> ing, does not mean they get by without a Special Use Permit. They would like <br /> to avoid the Special Use Permit. LaValle personally feels we don't need a <br /> special zone. <br /> MOTION: Spitzer made motion, seconded by LaValle, that the City Council <br /> notify the Planning Commission that it is not interested in the creation of <br /> another zone, and that the matter of the jt&ld Eagle Sportsmen Club can be <br /> treated in the zoning ordinance as it exists, and that the Planning Commis- <br /> sion give serious research and consideration to the inclusion of commercial- <br /> recreational activities as otherwise defined in the ordinance as permitted <br /> special uses in the Agricultural Districts. <br /> VOTING FOR: Spitzer and LaValle <br /> ABSTAINED: Schletty and Irsfeld. MOTION FAILED <br /> MOTION: Spitzer made motion, seconded by Schletty, that the City Council <br /> notify the Planning Commission that it is not interested in the <br /> creation of another zone, and that the matter of the Bald Eagle <br /> Sportsmen's Club can be treated in the zoning ordinance as it exists. <br /> VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld.
