1 late Bear Rod & Gun Club - Amended Special Use Permit cont, <br /> MOTION: LaValle made motion, seconded by Spitzer, that the request for an <br /> amended Special Use Permit by the White Bear Rod & Gun Club be <br /> denied. <br /> VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld <br /> MOTION CARRIED <br /> 5.8 Stewart Bogart - Nuisance Violation <br /> Mr. Bogart's residence was burned down, and nothing has been cleaned up. Mr. Bogart <br /> has been notified by certified mail of the nuisance violation, but the letters have <br /> never been picked up. The next step would be for the city to take civil action. <br /> MOTION: LaValle made motion, seconded by Spitzer, that Mr. Schletty have the <br /> city's maintenance department fence the hazard on the Stewart <br /> Bogart property, 7607 128th Street, as a tmeporary solution, and <br /> that the city attorney research the matter as to mortgage company <br /> involvement. <br /> VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld <br /> MOTION CARRIED <br /> 5.9 Aoorove Skelgas tank for maintenance building <br /> LaValle stated that it would benefit the city to purchase our own tank, so we can use <br /> only as much gas as needed. <br /> MOTION: Spitzer made motion, seconded by Schletty, to purchase the tank <br /> from Skelgas in the amount of $650.00. <br /> VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld. <br /> MOTION CARRIED <br /> 6.0 Off Sale Liquor Licenses - Cancelled <br /> 5..3 Dennis Killian - Variance <br /> Mr. Killian wants to purchase the KC Hall on Bald Eagle Lake, and construct a 24 x 24 <br /> gaikaTe on the south east side of the building. The garage would be 6' from the road <br /> right-of-way of the road. The Planning Commission recommended denial. It is not <br /> clear as to exactly where the right-of-way of the road is. Mr. Johnson stated that <br /> after six years of use on the road, it belongs to the city. Schletty stated that the <br /> city has public right-alless right next to the property in question. A garage there <br /> would create a visibility problem. The ordinance requires a 40' setback. <br /> MOTION: Schletty made motion, seconded by Spitzer, to deny the request of <br /> Dennis Killian for a variance because garage would be too close to <br /> the road. <br /> VOTING FOR: LaValle, Spitzer, Schletty, and Irsfeld <br /> MOTION CARRIED <br /> Mayor LaValle had received a copy of Washington County's Model Zoning Ordiance from <br /> Bill Schwab. <br />
