1 IaTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. <br /> NOTION CARRIED <br /> 8.0 UNFINISHED BUSINESS <br /> 8.1 Call for public hearing on abolishing rural tax district <br /> LaValle asked that the Coundil express their opinions regarding this matter. Spitzer <br /> stated that if we don't abolish the rural tax district, we would have the review � I <br /> i <br /> them annually. He also thought it would be wise to hold a public hearing, and inform <br /> the people as to exactly what the expenditures are for, and Irsfeld agreed. It was <br /> the general concensus that a public hearing would be in order, to better inform the <br /> people. It was also determined that more time would be needed in order to alt all <br /> the figures necessary. <br /> MOTION: Spitzer made motion, seconded by LaValle, that the clerk and mayor <br /> review any pertinent information regarding the urban and rural <br /> taxing districts that will be necessary for the public hearing. <br /> A new hearing date will be set January 16, 1978. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. <br /> NOTION CARRIED <br /> SHAVER CONTRACTING <br /> Mr. Johnson met with the Shafer's attorney, Frederick Collatz, and they mutually agreed <br /> upon a settlement of $156,000.00. The final settlement owed to Shafer Contracting for <br /> the 1975 Street and Storm Sewer Improvement Project — "Old Village" (Section 1 — Streets) <br /> will be $33,240.57. <br /> MOTION: LaValle made motion, seconded by Spitzer, that the engineer be <br /> authorized to write Change Orders for 1975 Street and Storm Sewer <br /> Improvement Project — "Old Village" (Section 1 — Streets), and <br /> authority to sign the Change Orders. <br /> $117,570.76 Paid on contract <br /> 20,747.79 Retainage owed <br /> 5,188.67 Hauling paid out of street fund <br /> 4,073.33 Additional hauling of excess <br /> 8.429.45 Additional excavating <br /> 156,000.00 TOTAL <br /> 33,240.57 Amount owed Shafer Contracting <br /> Further, that the attorney for the city be instructed to notify <br /> attorneys for the contractor that the necessary documents be filed <br /> to have the matter closed. Claim will be paid on December 19, 1977. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. <br /> MOTION CARRIED <br /> MOTION: Spitzer made motion, seconded by Schletty, that the mayor be authoriz- <br /> ed to sign the Chage Orders as submitted by Howard Kuusisto in regard <br /> to Shafer Contracting. Let the record show the the city understands <br />
