Permit not to <br /> be further renewed unless a Building Permit is granted. <br /> VOTING FOR: LaValle, Spitzer, Irsfead, and Vail. <br /> MOTION CARRIED <br /> 5.2 Joe Zasoel - Mobile Home Renewal <br /> MOTION: Spitzer made motion, seconded by LaValle, to renew the <br /> Mobile Home Permit for Joe Zaspel, 17205 Forest Blvd., <br /> under Chapter 40, Article III, Subdivision D, for a <br /> period of 90 days. <br /> VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. <br /> MOTION CARRIED <br /> 5...3 James Johnson - Mobile Home Renewal <br /> Mrs. Johnson presented the Council with a letter from Dr. Sommerdorf <br /> stating Mr. Johnson's inability to do any heavy work or to drive a <br /> heavy truck. LaValle questioned the fact as to whether the existing <br /> use of the land actually is being used as a farming operation. Mrs; <br /> Johnson stated that they are having trouble dealing with the land <br /> owner in obtaining legal title to their acreage. The matter is now <br /> in the hands of their attorney to try and resolve the problem. Mayor <br /> LaValle stated that his problem is with the Mobile Home Permit. He <br /> feels that the permit has stretched the rules and regulations beyond <br /> what it was intended for. LaValle stated that he will investigate <br /> the matter prior to the next renewal. <br /> MOTION: Spitzer made motion, seconded by LaValle, to renew the <br /> Mobile Home Permit for James Johnson, 7194 132nd <br /> Street North, under Chapter 40, Article III, Sub- <br /> division D, for a period of 90 days, but terminal <br /> renewal under outstanding permit. <br /> VOTING FOR: LaValle, Spitzer, and Vail <br /> VOTING AGAINST: Irsfeld <br /> MOTION CARRIED <br /> 1,4 Robert McCullough - Rezoning <br /> The City Clerk checked with Dan Koehler in regard to proof of ownership <br /> regarding this rezoning. Mr. Koehler checked with the County Recorder, <br /> and they stated that there has been no change in title since 1975. A <br /> letter stating this will follow. The clerk also stated that one parcel <br /> of land had already been registered at the county. Mr. Johnson, City <br /> Attorney, suggested that the city should get some sort of more complete <br /> proof of ownership other then checking with county records. He would <br /> not recommend going ahead with the rezoning at this time. <br /> MOTION: Spitzer made motion, seconded by Irsfeld, that the McCullough <br /> rezoning request be tabled, and that the applicant be <br /> notified that no further action will be taken on the matter <br /> until adequate proof of ownership can be provided to the <br /> city's engineer and attorney. <br />
