22 FEBRUARY 5, 1979 <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> Rehbein Deed Approval <br /> Attorney Johnson stated that the Rehbein's are requesting to sell <br /> two houses with 5 acres of land each. The land lies in the Con- <br /> servancy and Agricultural zoning districts. Mr. Wilcox, attorney <br /> for Rehbein's, stated that the houses have been rented since 1969, <br /> and would not change the use of the land when sold. LaValle stated <br /> that the property in question has, in fact, not been a separate <br /> survey until just recently. The land has not been divided. In <br /> order to divide the property, the Zoning Ordinance must be complied <br /> with. The Rehbtns could sell the house in the Agriculture zone with <br /> 10 acres, and make application for a rezoning for the other house <br /> from Conservancy to Agriculture. <br /> MOTION: Spitzer made motion, seconded by Irsfeld, that the <br /> City Clerk is to approve no deeds that are in conflict <br /> with the Zoning Ordinance and existing zoning. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> 6.8 Engineer <br /> Kuusisto will be submitting his monthly report via mail. <br /> MOTION: Spitzer made motion, seconded by Schletty, to extend <br /> the meeting past 11 :00 P.M. <br /> All aye. Motion Carried. <br /> 6.9 Clerk <br /> The clerk stated that the city has received complaints regarding <br /> the snow covered sidewalks in town. Mr. Johnson will check on <br /> previously established regulations. <br /> The Clerk stated that Vern Peloquin had questioned the procedure <br /> for establishing parkland fees. It was determined that the city <br /> should accept 10% of the market value of the land or $50.00 per <br /> lot, whichever is greater. <br /> 5.1 James Brevig - Special Use Permit <br /> Mr. Brevig was present and stated that he has been unable to obtain <br /> a letter of credit to cover his Special Use Permit. LaValle stated <br /> that the permit requires a bond, and not a letter of credit, and <br /> that Mr. Brevig does not have a permit because all the conditions <br /> required have not been met. Mr. Brevig would have to make applica- <br /> tion for an Amended Special Use Permit if he desires to change the <br /> use of the proposed building. Mr. Johnson stated that in the future, <br /> a time limit should be attached to permits to make sute. all condit- <br /> ions are met. <br />
