Schwartz, Bernier - Rezoning <br /> MOTION: LaValle made motion, seconded by Irsfeld, to table <br /> the matters until the meeting of March 5, 1979. <br /> VOTING FOR: LaValle, Irsfeld and Vail <br /> MOTION CARRIED <br /> 5.3 Gerald Dabe - Discussion on road <br /> Mr. Dabe and his attorney, David Doyscher, were present at the meet- <br /> ing. Mr. Doyscher stated that when the land was acquired from Mr. <br /> Perreault there was an agreement that when the land was developed, <br /> the easement was to be dedicated to the city. However, the intent- <br /> ionwas not clearly on the registered documents. Mr. Dabe has been <br /> unable to settle the matter out of court. Mr. Doyscher presented <br /> the city with a petition requesting that 1 ) the city accept and <br /> dedicate the property for a public road, or 2) initiate such pro- <br /> ceedings as are necessary pursuant to M.S. 117.011 et seq (eminent <br /> domain) in order to acquire said premises for dedication as a pub- <br /> lic road.. <br /> MOTION: LaValle made motion, seconded by Irsfeld, that the <br /> city received the petition from Gerald and Sandra <br /> Dabe regarding easement for road purposes, and the <br /> petitioners are here by asking the City of Hugo to <br /> do the following: <br /> 1 . To accept and dedicate the easement for a public <br /> road. <br /> 2. To initiate such proceedings as are necessary <br /> pursuant to M.S. 117.011 et seq (eminent domain) <br /> in order to acquire said premises for dedication <br /> as a public street. <br /> VOTING FOR: LaValle, Irsfeld and Vail <br /> MOTION CARRIED <br /> MOTION: LaValle made motion, seconded by Irsfeld, to table <br /> Item 1 of the petitioner's request until the deter- <br /> mination of the basis of objection of the underlying <br /> fee owner to the dedication of public purpose, and <br /> the ability to convey the easement by the petitioners <br /> (Gerald and Sandra Dabe) . <br /> VOTING FOR: LaValle, Irsfeld and Vail <br /> MOTION CARRIED <br /> MOTION: Irsfeld made motion, seconded by Vail, that the City <br /> of Hugo deny the Item 2 of the petitioners' request <br /> to initiate such proceedings as are necessary pur- <br /> suant to M.
