APRIL 2, 1979 39 <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> NOTION CARRIED <br /> 5.3 Mardon Homes - Subdivision <br /> Mr. Tramm was present, and stated that he was unable to provide <br /> the restrictive covenants, as requested, because he was unclear as <br /> to what was required. The city does not have any specific covenants <br /> they would like to see attached to the subdivislbn. The covenants <br /> would be a matter between the developer and prospective land pur- <br /> chaser. Johnson stated that any covenants should be provided so <br /> that they can be recorded at Washington County along with the final <br /> plat. LaValle felt that future buyers should be aware of the pro- <br /> blems that could materialize because of the long driveways (access <br /> by emergency vehicles) . Johnson stated that this could be made <br /> part of the restrictions. Before final plat is submitted, Tramm <br /> is to provide restrictive covenants for the attorney's review, the <br /> bond to cover construction of the road, and a parkland dedication <br /> will have to be determined. <br /> NOTION: Spitzer made motion, seconded by Irsfeld, to approve <br /> the preliminary plat for Mardon Homes. The Planning <br /> Commission is directed to obtain, for review by the <br /> City Attorney, restrictive covenants as may be im- <br /> posed, and determine the parkland dedication. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> 5.4. .Robert Dotte - Special Use Permit <br /> Mr. Dotte is requesting authorization to construct a 40' x 64 ' pole <br /> barn on his property on 165th Street to store equipment. It was <br /> determined that a Variance is applicable rather than a Special Use <br /> Permit. <br /> MOTION: Irsfeld made motion, seconded by Vail, to grant a <br /> Variance to Robert Dotte to construct an accessory <br /> building prior to erection of the primary structure, <br /> according to Chapter 320-9. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> MOTION CARRIED <br /> MOTION: Spitzer made motion, seconded by Schletty, for approval <br /> of the Site Plan of Robert Dotte, as submitted. <br /> VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail <br /> NOTION CARRIED <br />
