February 2, 1981 <br /> 5.5 Richard Vail - Subdivision <br /> The Planning Commission forwarded Mr. Vail's preliminary plan to the City Council <br /> with various recommendations attached. They have recommended that the plan be <br /> altered to include a total 11 lots rather than 15. Mr. Vail stated that the <br /> project would have to be dropped if the plans were changed to 11 lots, because <br /> it would not be economically feasible to continue. Permits could not be obtained <br /> from Rice Creek until the number of lots was determined. Engineer Kuusisto re- <br /> quested that he receive a drainage plan for the development, and that the surveyor <br /> correct the errors on dimensions. The present City Ordinance calls for a distance <br /> of 100' from the lake for the construction of a house. Johnson stated that when <br /> the zoning ordinance was adopted, DNR had no standards at that time. They have <br /> now set a standard of 150' on certain kinds of lakes. If these standards have <br /> been officially adopted, Johnson stated that their design would take precedence <br /> over the city's. After further review of the plan, it was determined that Mr. <br /> Vail would be hard pressed to meet the setback requirements for a number of lots <br /> lying along the lake side. LaValle also stated that the city would have to <br /> obtain the high water mark for Egg Lake before any setbacks could be determined. <br /> Before any further action can be taken on the application for subdivisio, LaValle <br /> requested the following information be obtained: 1 ) the high water mark as <br /> determined by the DNR, and after that is determined, 2) Attorney Johnson in- <br /> vestigate the regulations regarding the setback requirements from the lake. <br /> MOTION: McAllister made motion, seconded by Irsfeld, to table this matter <br /> until the meeting of February 17, 1981 , when the City Engineer and <br /> City Attorney will provide the appropriate information. <br /> VOTING FOR: LaValle, McAllister, Irsfeld, Vail <br /> MOTION CARRIED <br /> 6.0 REPORTS OF OFFICERS & COMMITTEES <br /> 6.1 Ordinance Committee - No discussion <br /> 6.2 Planning Commission <br /> MOTION: LaValle made motion, seconded by Irsfeld, to reappoint Mr. Ken Lorch <br /> to the Planning Commission. <br /> VOTING FOR: LaValle, McAllister, Irsfeld, Vail <br /> MOTION CARRIED <br /> 6.3 Water Superintendent <br /> Mr. Burkard was present to discuss the possible adjustment of sewer rates. He <br /> stated that he cannot make any determinations until after the April billing. The <br /> Council discussed the numerous problems the city has with the metering of sewage, <br /> and MWCC's unwillingness to try and resolve a number of questions and problems. <br /> The City Engineer will put together a program for monitoring flows, and report to <br /> the City Council. <br /> 6.4 Building Inspector <br /> Mr. Crever submitted his monthly report. <br /> 6.5 Attorney <br /> Mr. Johnson submitted his monthly report. <br />
