February 17, 1981 5.6 Refund of Building Permit Fee - Benson Kennel Councilman Schletty questioned the refund on the two building permits being issued stating no refund should be given as excessive administrative time was given on the Benson Kennel. MOTION: Irsfeld made motion, seconded by LaValle, to refund $322.50 to Joseph E. Johnson & Son, Inc. , for duplication of building permits. VOTING FOR: Irsfeld, LaValle VOTING AGAINST: McAllister, Schletty MOTION FAILED The request for a refund was tabled until March 2 when there would be a full quorum to vote on the matter 5.7 Richard Vail - Shamrock Glen Subdivision Attorney Johnson discussed his letter, including input from the engineer. The Clerk was directed to forward the letter to Mr. Vail to incorporate the information in his future plans for Shamrock Glen. MOTION: Irsfeld made motion, seconded by Schletty, to table the matter until the meeting of 3/2/81 . VOTING FOR: LaValle, McAllister, Irsfeld, Schletty MOTION CARRIED 5.8 Jeffrey Barbour - Rezonings The rezonings were requested by Mr. Barbour so he could meet setback requirements. MOTION: Irsfeld made motion, seconded by LaValle, to adopt ORDINANCE 175, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING' BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to adopt ORDINANCE 176, AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. VOTING FOR: LaValle, McAllister, Schletty, Irsfeld MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, that the new legal description be made part of the prior land division for Fred Benson and Jeff Barbour which the city approved.
