September 21 , 1981 <br /> 5. 11 Dennis & Linda Macklin - Land Division <br /> Ron Johnson, the realtor representing Jean Turner, Gayle Beeman, and Linda Macklin, <br /> who are the owners of 30 acres in Section 1. They are proposing the division of <br /> the 30 acres in to 3 10 acre parcels. A Certificate of Survey and proof of ow- <br /> nership were provided. Mr. Johnson noted that owners of property in Forest Lake <br /> Township had encroached on land noted as Parcel C. Irsfeld stated that a Minor <br /> Subdivision would be required with a restrictive covenant attached to the deed <br /> stating that the land is not considered buildable in the City of Hugo. <br /> MOTION: Irsfeld made motion, seconded by Schletty, to approve the Land Division <br /> for Jean Turner, Gayle Beeman and Linda Macklin, to divide 30 acres into <br /> 3 10 acre parcels subject to the following: that on Lot C no Building <br /> Permit will be issued until a Minor Subdivision is approved clearing up <br /> the encroachment on Lot C. <br /> VOTING FOR: LaVaile, McAllister, Schletty, Irsfeld <br /> MOTION CARRIED <br /> Mr. Johnson will not have to appear before the Planning Commission, but appear <br /> before the City Council at the time he has a new survey and a new deed with a re- <br /> strictive covenant stating that the land to be divided from Lot C is not a buildable <br /> lot. <br /> 5.9 Homer Dole - Perc test (Lot 4) <br /> Engineer Kuusisto reviewed the perc test as taken by White Bear Soil Testing, and <br /> suggested that they consider raising the design to within the top 1 ' area so that <br /> they would be 4 to 5' above the water table, then fill over that area with suitable <br /> fill, in lieu of what they have proposed. Kuusisto felt that they should keep as <br /> high from ground water as possible, and Tom Crever concurred with his recommenda- <br /> tion. Mr. Crever stated that Mr. Craig Thaemert is proposing the moving in of a <br /> 60 year old house onto Lot 4. He stated that the house was in a deteriorating <br /> condition and was not up to code (windows, plumbing and heating) , and questioned <br /> whether the city should allow a house in this condition would benefit the sur- <br /> rounding area. Mr. Thaemert was present, and stated that he would be remodeling <br /> the house and bringing it up to state codes. <br /> MOTION: McAllister made motion, seconded by Irsfeld, in accordance with Chapter 40, <br /> Article II, a Letter of Credit, in the amount of $15,000, will be required <br /> prior to the issuance of any Building Permit, to insure that the structure <br /> will be brought up to State Building Codes; specifically, the upper bedroom <br /> windows be installed according to State Building Codes, that the exterior <br /> restoration be acceptable to the city, that the heating, plumbing and <br /> wiring conform and pass necessary final inspections, that the septic sy- <br /> stem be installed in accordance with the City Engineer's recommendations, <br /> that all provisions of the Letter of Credit will be met within six (6) <br /> months of the date of the Building Permit. Part of the Letter of Credit <br /> will be consent by the property owner(s) for the City of Hugo to bring <br /> the building up to State Building Codes should the holder of the Letter <br /> of Credit fail to do so. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld <br /> MOTION\CARRIED <br />
