36 <br /> 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES <br /> 5.1 John Ott - Discussion on Land Division <br /> Mr. Ott presented a proposal the division of 20 acres lying along 180th Street. <br /> After review by the Council, it was determined that the parcels have already been <br /> divided, and requires no further action by the city. There are already two deeds <br /> and they have been recorded. <br /> 5.2 Roger DuPaul - Renting of North half of Hugo Auto Parts <br /> Not present <br /> 5.3 David Schuman - Land Division <br /> Mr. Schuman, and his surveyor, Barry Stack, were present, and stated that perc tests <br /> have been taken and proof-of-ownership provided, as previously requested. Mr. <br /> Schuman is proposing the division of 80 acres into 7 parcels. A public hearing <br /> has been set for May 3, at 8:00 PM, for the vacation of the easement through the <br /> property. Mr. Schuman is particularly interested in the division of Lots 4 and 7, <br /> but would like .the Council to act on the entire Land Division. At this time, <br /> legal descriptions for all parcels has not been submitted. Mr. Stack stated <br /> that it could be done soon - just of matter of typing. <br /> MOTION: McAllister made motion, Irsfeld seconded, to approve the Land Division for <br /> David Schuman, to divide 80 acres into 7 parcels, subject to the re- <br /> ceipt by the Clerk's office, and review by the City Attorney, of proper <br /> legal descriptions for each of the 7 parcels. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld <br /> MOTION CARRIED <br /> 5.4 William Clark - Bond Expires July 1 , 1982 <br /> Mr. Clark has a $2,500 bond relative to the construction of his house on Lot 5, <br /> Blcok 1 , Royalhaven Estates 1 , and it will expire July 1 , 1982. Tom Fast stated <br /> that he will set up a time and date for the engineer, councilmen, and Mr. Clark to <br /> meet at the site, and seek an answer to the problems that exist (erosion control) . <br /> 5.7 Darrell Tavernier - Licenses <br /> MOTION: LaValle made motion, McAllister seconded, to approve the following licenses <br /> for Darrell Tavernier, LAKEVIEW INN, 4444 129th Street North: OFF SALE <br /> NON-INTOXICATING LIQUOR, ON SALE NON-INTOXICATING LIQUOR, and CIGARETTE <br /> LICENSE, in the amount of $123.00. <br /> VOTING FOR: LaValle, McAllister, Schletty, Irsfeld <br /> MOTION CARRIED <br /> 5.5 Zimco Wood - Termination of Special Use Permit <br /> The public hearing to consider the termination of the Special Use Permit issued <br /> to Zimco Wood was called to order at 8:00 PM. All conditions of the permit had <br /> not been met, specifically Item 5, requiring a Letter of Credit to guarantee dust <br /> control. Zimco's last Letter of Credit expired April 1 , 1982.
