RESOLUTION 2015-50 <br /> APPROVING PUD GENERAL PLAN FOR DIGNICARE,LLC.FOR PROPERTY <br /> LOCATED SOUTH OF 130TH ST.AND EAST OF FOREST BLVD.(TH 61) <br /> WHEREAS, DigniCare LLC has requested approval of a PUD general plan to allow 32 <br /> senior living and memory care units on the 3.34 acre property legally described as <br /> follows: <br /> (See Attached) <br /> WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br /> called Public Hearing and recommends approval,and; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br /> request by DigniCare, LLC., subject to the following conditions: <br /> 1. A PUD general plan is approved to allow the creation of 32 senior living and memory <br /> care units. The development shall be constructed in accordance with the plans and <br /> application received by the City on August 25, 2015, and revisions received on <br /> September 18,2015 and October 1,2015, except as amended by this resolution. <br /> 2. Approval is contingent upon City Council approval of the requested rezoning of the <br /> 3.34 acre property. <br /> 3. The PUD general plan is approved based on the finding that the proposed project is <br /> consistent with the City's Comprehensive Plan. <br /> 4. PUD flexibility is granted to allow: <br /> a. Flexibility to allow senior housing as a land use. <br /> b. Flexibility to allow a density of 9.5,where 3-4 units per acre are allowed. <br /> c. Flexibility to allow a 22 ft. rear yard setback, where 30 ft. is the minimum <br /> allowed by ordinance in the underlying zoning district. <br /> 5. The building setbacks for the PUD are as follows: <br /> a. 30 feet front yard setback. <br /> b. 10 feet side yard setback. <br /> c. 22 feet rear yard setback. <br /> 6. The applicant must comply with the following, prior to the issuance of a building <br /> permit: <br />
