MINUTES <br />HUGO BOARD OF ADJUSTMENTS AND APPEALS <br />May 8, 2003 <br />Chairperson Schumann called the meeting to order at 6:35 p.m. <br />PRESENT: Brunotte, Puleo, Schumann <br />ABSENT: None <br />ALSO PRESENT: John Rask, Community Development Director <br />Michele Lindau, Secretary <br />Minutes April 24, 2003 <br />Puleo made motion, Brunotte seconded, to approve the minutes for April 24, 2003, as <br />submitted. <br />All Ayes. Motion carried. <br />Gressen Variance for Garage <br />The Board considered the request of Greg and Cara Gressen, 8620 126th Street <br />North, for a variance to permit a 13 -foot side yard setback for a garage and living <br />space addition to their home. The addition would provide 598 square feet <br />additional garage space and 952 square feet additional living space. The property <br />consists of 5.4 acres in the Rural Residential Zoning District where the City's <br />Comprehensive Land Use Regulations require that buildings be set back 40 feet <br />from the side lot line. <br />The Community Development Director explained that the existing home was non- <br />conforming because it was located approximately 25.5 feet from the side lot line. <br />At the time the home was constructed, the side yard setback was 20 feet. Because <br />the zoning ordinance permits the expansion of non -conforming buildings provided <br />the expansion does not increase the non -conformity, the applicant could expand <br />the building provided the expansion was no closer than 25.5 feet from the side lot <br />line. It was noted that the garage portion of the addition would extend into the <br />required setback of 25.5 feet and no variance would be needed if the applicant <br />eliminated the garage portion of the addition. <br />Tim and Bonnie Elemes, 8630 126th Street North, said that their home was built <br />in 1985 in the center of their lot, which is located adjacent to the Gressens to the <br />east. The Elemes said they were disappointed when neighbors on both sides built <br />
