Board of Zoning Adjustments Meeting May 10, 207 - page 2 <br />Strub/Kruse Variance for Property Line Adiustment <br />The Board considered the request of David and Jane Strub, 12670 Ingersoll Avenue North and <br />Doug and Judith Kruse, 12616 Ingersoll Avenue North, for a variance from the Rural Residential <br />lot size and width requirements to allow a property line adjustment of the common lot line <br />between their properties. The applicants were requesting to move the lot line 20 feet to the <br />south. Hugo Zoning Code, Chapter 320, states that if a property line adjustment causes either <br />property to remain or become out of compliance with the ordinance, a variance would be <br />necessary. Both properties would remain out of compliance with the zoning ordinance, which <br />requires a minimum parcel size of 10 acres and 300 feet road frontage. The lots are located on <br />the eastern shore of Sunset Lake. The lot line adjustment would result in the Strub property <br />being approximately 8,500 with 100 feet of road frontage, and the Kruse property approximately <br />3,800 square feet with 50 feet of road frontage. <br />The Associate Planner explained the properties were platted as Sunset Park in 1956 with 29 lots <br />along the east side of sunset lake and most of the lots are less than one acre. The lots became out <br />of compliance with the zoning ordinance when the 10 acre lot size and 300 foot road frontage <br />requirement was adopted. Therefore, because the lots would remain out of compliance, a <br />variance was necessary. <br />Schumann asked if making the one lot slightly smaller would have any effect on the septic <br />system. <br />Kruse stated it would not. <br />Schumann opened the public hearing. Other than the applicant, there was no one present who <br />wished to speak on the request. Schumann closed the public hearing. <br />Schumann made motion, Brunotte seconded, to recommend approval of the variances for 12670 <br />and 12616 Ingersoll Avenue North. <br />All Ayes.
