Puleo added that he felt not every parcel in Hugo needed to be able to accommodate <br />horses. Puleo and Schumann agreed that the owner of a smaller parcel could possibly lease <br />neighboring land to allow them to have horses. <br />Schumann noted there would be no more nonconformity created that what existed now and Puleo <br />said one parcel would be brought into conformance to the 10 -acre lot minimum requirement. <br />Schumann made motion, Puleo seconded, to recommend approval of the variances as requested. <br />All Ayes. Motion carried. <br />Gaertner Variance for Oversized Garage <br />The Board considered the request of David Gaertner, 8455 136th Street North (Duck Pass) for <br />variances to permit construction of a 1,080 square foot accessory garage 19 feet from the side lot line <br />where 40 feet is required, 25 feet from the front property line where 40 feet is required, and to locate <br />the accessory garage closer to the road than the principle structure at 8455 136th Street North (Duck <br />Pass). <br />The location of wetlands and the septic system prevented the applicant from locating the garage <br />elsewhere on the property. The applicant was proposing to construct the accessory building 14 feet from <br />the home. Staff noted that the applicant could move the garage over one -foot to provide a 20 -foot side <br />yard setback. At the time Duck Pass was approved, the required side yard setback was 20 feet. <br />Puleo noted that only the corner of the garage would be 19 feet from the lot line and asked the <br />applicant if there was a reason he needed 14 feet between the garage and the home. Mr. Gaertner <br />explained there was a large tree between the house and garage he did not want to disturb it. <br />Puleo said he saw no need to have the corner of the building setback 20 feet and Schumann agreed <br />he did not want to endanger the tree. <br />Puleo made motion, Schumann seconded, to recommend approval of the variances as requested. <br />All Ayes.
