t <br />1 <br />� r <br />RESOLUTION 2005 - 37 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR THE <br />ROTTLUND COMPANY, INC. FOR VICTOR GARDENS NORTH VILLAGE 2ND <br />ADDITION <br />WHEREAS, The Rottlund Comany, Inc. has requested approval of a Final Plat for <br />"Victor Gardens North Village 2 Addition" on property legally described as follows: <br />Outlot A, Victor Gardens, according to the recorded plat thereof, Washington <br />County, Minnesota, EXCEPT that part lying southerly of the following described line: <br />Commencing at the southeast corner of said Outlot A; thence north 00 degrees 27 <br />minutes 16 seconds east, assumed bearing along the east line of said Outlot A, a <br />distance of 855.16 feet to the point of beginning of the line to be described, thence <br />westerly along a non tangential curve, concave to the south having a central angle of <br />38 degrees 08 minutes 28 seconds, a radius of 590.00 feet and on an arc distance of <br />392.76 feet, the chord of said curve bears north 82 degrees 39 minutes 27 seconds, a <br />radius of 8 7. 00 feet and on arc distance of 212.06 feet the chord of said curve bears <br />south 78 degrees 16 minutes 29 seconds; thence south 78 degrees 16 minutes 29 <br />seconds west, not tangent to said curve, a distance of 27.18 feet, thence westerly <br />along a tangential curve concave to the north having a central angle of 21 degrees 46 <br />minutes 49 seconds, a radius of 570.00 feet and an arc distance of 21668 feet; thence <br />north 79 degrees 56 minutes 42 seconds west, tangent said curve, a distance of <br />11 7.56feet; thence westerly along a tangential curve concave to the south, having a <br />central angle of 9 degrees 40 minutes 16 seconds, a radius of 830.00 feet and an arc <br />distance of 140.10 feet; thence north 89 degrees 36 minutes 58 seconds west, tangent <br />to said curve, a distance of 182.90 feet to the west line of said Outlot A and said line <br />there terminating. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does ayprove the final <br />plat for The Rottlund Company, Inc. for Victor Gardens North Village 2 Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the creation of 10 condominium lots for 82 <br />townhomes, 1 common lot and 1 outlot for future development, in accordance <br />with the plans received by the City on May 26, 2005 and June 16, 2005, except as <br />amended by this resolution. <br />
