RESOLUTION 200544 <br />APPROVING MINOR SUBDIVISION AND CONDITIONAL USE PERMIT FOR <br />CURT LEIBEL FOR PROPERTY LOCATED AT 16675 HENNA AVENUE <br />WHEREAS, Curt Leibel has requested approval of a minor subdivision to create two lots <br />on the 20 -acre property legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed the minor subdivision at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Curt Leibel for a minor subdivision, subject to the following conditions: <br />1. A minor subdivision is approved to allow the creation of two lots, in accordance with <br />the plans and application received by the City on June 6, 2005, except as amended by <br />this resolution. <br />2. Prior to release of the resolution for filing, the applicant must revise the plans to show <br />both a primary and a secondary septic site for the southernmost parcel. <br />3. Prior to release of resolution, the applicant must provide septic percolation tests to <br />ensure the viability of the primary and secondary septic sites. <br />4. The applicant will need to obtain a septic system permit from Washington County <br />Environmental Services for the new lot. <br />5. Prior to release of the resolution for filing, the applicant must revise the plans to show <br />Hardwood Creek on all parcels and the location of the shoreland overlay district <br />boundary. <br />6. The park dedication shall be cash -in -lieu of dedication for the new lot and is due prior <br />to release of this resolution for filing at Washington County. <br />7. Low floor elevations and low building opening elevations must be at an elevation of <br />930.0 or higher. <br />8. Prior to issuance of building permits, the applicant must provide a grading plan that <br />reflects the current topography and proposed grading. <br />9. Delineated edge of wetland will need to be defined and avoided during all phases of <br />grading and construction. <br />10. The required setback from Hardwood Creek is 100 feet for buildings and 50 feet for <br />septic systems. <br />
