P <br />RESOLUTION 2004-04 <br />APPROVING A PUD GENERAL PLAN FOR MASTERPIECE HOMES, INC. <br />FOR "NORTHERN PINES" ON PROPERTY LOCATED AT THE NORTHEAST <br />QUADRANT OF HIGHWAY 61 AND 125 m STREET <br />WHEREAS, Masterpiece Homes, Inc. has requested approval of a PUD General Plan to <br />allow construction of 38 homes on the 12.3 -acre property legally described as follows: <br />All that part of the southeast quarter of the northeast quarter of Section 31, <br />Township 31 north, Range 21 west of the fourth principal meridian, lying <br />east of the east line of Lake Superior and Mississippi Railroad Company's, <br />a corporation, right-of-way as described in that certain Document of <br />Record dated February 12, 1874, recorded April 24, 1878 in the Book of <br />Deeds Number Three (3) at page one hundred and seventy-three (173) and <br />filed in the office of the County Recorder of Washington County in the <br />State of Minnesota. <br />Except that part taken for U.S. Highway No. 61. <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE. CITY. COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Masterpiece Homes, Inc. for a PUD general plan, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 38 twinhomes and two <br />common lots, in accordance with the plans received on November 26, 2003, except as <br />amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested rezoning and <br />preliminary plat. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. Development standards for the PUD shall be as indicated on the plans dated <br />November 26, 2003, except as amended by this resolution. <br />5. The applicant shall provide copies of the HOA documentslcovenants for City review. <br />
