1s <br />RESOLUTION 2003-3 <br />APPROVING PUD AMENDMENT FOR POA/SCHERER, LLC. FOR VICTOR <br />GARDENS 3r4 ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND <br />EAST OF EXISTING ELMCREST AVENUE NORTH <br />WHEREAS, POA/Scherer, LLC. has requested approval of a PUD amendment to allow <br />construction of 99 townhomes on property legally described as follows: <br />Outlot B, Victor Gardens, according to the recorded plat thereof, Washington <br />County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the PUD amendment at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the PUD <br />amendment for POA/Scherer, LLC on property located south of CSAH 8 and east of <br />Elmcrest Avenue, subject to the following conditions: <br />1. A PUD concept plan is approved to allow construction of a 99 townhome units on 13 <br />lots, two common lots and two outlots, in accordance with the plans and application <br />received by the City on December 9, 2002 and December 20, 2002, except as <br />amended by this resolution. <br />2. The development shall be consistent with Victor Gardens PUD concept plan <br />approvals (Resolution 2000-47), except as otherwise noted. <br />3. All platted townhome lots shall comply with the following setbacks: <br />Front yard from public street <br />15 feet <br />Between buildings <br />20 feet <br />Setback around the perimeter of the site <br />exterior property lines <br />30 feet <br />From commercial property line <br />15 feet <br />Required Parking for townhomes <br />includin ara a stalls <br />2.5 stalls per unit <br />4. The applicant shall obtain all necessary local, state, and federal permits. <br />5. The applicant shall develop and implement architectural review and design guidelines <br />for all townhome buildings. The buildings materials would be maintenance free and <br />would include stone accents on the main level, vinyl lap and shake siding and asphalt <br />roofing. <br />
