MINUTES OF THE CITY COUNCIL MEETING OF JUNE 6_,_1995 <br />The City Council meeting of June 5. 1995, was reconvened at 7:00PM by <br />Mayor Miron. <br />Members Present: Barnes, Goiffon, LaValle, Miron <br />Members Absent: Leroux: <br />Others Present: Robert MUseus, City Administrator <br />ATM:INSON AGREEMENT <br />The first item of business was a discussion with Dean Atkinson regarding <br />an agreement for his operation of a rock crusher in his gravel pit located <br />in the southwest quadrant of the intersection of Irish Ave. and 147th St. <br />Mr. Atkinson provided the Council with his response to a draft agreement <br />prepared by the City Attorney consisting of nine items. Gen.erally, his <br />concerns regarding the amount of material he is allowed to stockpile on <br />the site in a given year and his ability to crush for recycling purposes <br />bituminous and concrete materials. <br />Councilmember LaValle expressed concerns about final contours for the <br />mining site and there was considerable discussion regarding past <br />operations on the site. Mr. Atkinson stated that he had "grandfathering <br />rights" to continue recycling materials on the site on a limited basis. <br />He also stated that he felt there were 30u0,000 to 40u0,000 cubic yards of <br />material to be mined from the site. <br />A resident owning property adjacent to the Atkinson gravel pit, Larry <br />Hansen, 14355 Irish Ave. argued that Mr. Atkinson did not have <br />grandfathering rigFit.s for the continued operation of the rock crusher on <br />the site since Mr. Atkinson had not operated a rock crusher on site for <br />over a year. He did indicate that the rock crusher was incidental to the <br />mining of materials on the site, as well as some materials brought in to <br />manufacture a saleable product combined with materials from the site, but <br />felt that hauling materials solely for the purpose of crushing was not <br />appropriate. <br />Barnes made motion, seconded by LaValle to table further discussion of the <br />agreement to the Council meeting of July 5. 1995. <br />All aye, motion passed. <br />The City Administrator then provided the Council an Update on the status <br />of the Special Use Permit/Mining application of Fiver City Asphalt. He <br />stated that the applications for both permits had recently been received <br />from FCA and the watershed is close to approving a mining and restoration <br />plan for the site. The special Use Permit will be the subject of a <br />hearing before the planning commission on June 28, 1995, and the Council <br />may receive the SUP and Mining permit for consideration at their meeting <br />Of July 5, 1995. <br />The Council wns briefed by the city administrator as to his negotiations <br />with Grace Development Corp. and the Oakshore Park Homeowners Association <br />to settle remaining concerns regarding the proposed Woods of Bald Eagle <br />
