MINUTES OF THE PROCEEDINGS <br />OF THE HUGO PLANNING COMMISSIO14 <br />NOVE14BER 109 1976 <br />The meeting was called to order by Chairman Spitzer at 8:04 P.M. <br />Attending were Spitzer, Peloquin, Peltier, Rosenquist, Greger, Ehret, <br />Gillen, and Bill Schwab, Washington County Planning Commissioner. <br />Motion made by Ehret, seconded by Greger, to approve the minutes <br />of the October 27 , 1976 meeting after the following change was <br />made: Page 2 — Applicant for Special Use Permit for Little Lamb's <br />Preschool is actually Shepherd of the Fields Church, not June Smith. <br />Bald eagle Sportsman Club <br />Attorney Peters called and stated that material was not ready for <br />the meeting. Would tentatively like matter delayed until December <br />8th meeting. Chairman Spitzer suggested that they defer any action <br />until after the first of the year. <br />White Bear Rod and Club <br />Ehret made motion, seconded by Rosenquist, to consider the supplement <br />to set agenda regarding Mr. Perron's request. All aye. <br />Mr. Perron quoted Section 21 of the Special Use Permit in regards <br />to a variance in the case of undue hardship. After the Special <br />UsP Permit was reinstated, Mr. Perron wanted to bring up the matter <br />now before anyone else did. Mr. Perron then quoted Section 13 <br />(corrected to read Section 9) in regards to the standards of the <br />Pollution Control Agency. Mr. Perron stated that the club would <br />conform to the results of a study being conducted by Mr. Perez. <br />Spitzer stated that Mr. Perron would like a change from the 40 <br />decibels as stated in Section 9, but has not submitted any new <br />number. Mr.. Perron stated that he was not sure how he could come <br />up with a figure. Peltier submitted two letters for consideration <br />from International Acoustical Testing Laboratories, dated December 41 <br />1973 and February 8, 1974, regarding reports on sound level survey <br />conducted at the proposed site of the White Bear Rod and gun Club. <br />Chairman Spitzer read said letters, and asked they be made part of <br />our current file. Gillen stated that variance request should read <br />modification of Section 89 not deletion. Chairman Spitzer itemized <br />what information Mr. Perron would need before a variance could be <br />considered: 1 — on what hardship basis is Mr. Perron asking for a <br />variance, 2 — make a specific request in terms of peak amplitude <br />at property .line, 3 — how peak amplitude will be measured with expert <br />testimony supporting methods, and 4 — that noise levels should be <br />compared in neighborhood in conjunction with other noises occurring <br />at various times of the year. After data has been compiled, Mr. <br />Perron should file an application for variance to the Special Use <br />Permit, and submit to the Planning Commission for review.
