f o 1,1' <br />AUGUST 20, 1975 <br />The regular meeting of the Lino Lakes Planning and Zoning Board was called <br />to order at 8:05 P.M. by Chairman Karth. Members present: Mr. Kelling, <br />Mr. Nadeau, Mr. Shearan and Mr. Gourley. Members absent: Mr. Houle, <br />and Mr. Hill. Councilman Marier and Attorney Locher. <br />The minutes of the July 16, 1975 meeting were approved as presented by <br />a motion from Mr. Kelling. Mr. Shearan seconded the motion. Motion approved. <br />The first item on the agenda was a request from Mr. and Mrs. Kelly <br />Baumgart to build a garage in front of their home located at 6133 Ware <br />Road in Lino Lakes. The Baumgart's had appeared at the July meeting and <br />were asked to come back with a specific description of where the want to <br />place the garage and the exact measurments from the road. <br />The Baumgart's presented copies of their perc test and a survey of the <br />land to show the exact measurments. <br />Mr. Karth aratced If the exact measurments of the drain field was available? <br />Mr. Baumgart said no, the measurments on the copy of the perc test were <br />only approximate measurments but they are the best they can come up with. <br />Mr. Kelling questioned the effect a garage in the front would have on <br />the rest of the neighbors. Mr. Karth and Mr. Baumgart said that the <br />land on either side of the Baumgart residence were now empty. <br />Mr. Karth asked when the house was built. Mr. Baumgart said the house was <br />built in 1952 and the perc test was done in 1972 when they purchased the house. <br />Before 1972 there was no plumbing of any sort there. <br />Mr. Karth asked again about a tuck under garage and Mr. Baumgart said that <br />it would cause more problems, particularly with water, than it would be <br />worth. <br />Mr. Shearan said that if the garage were placed where the Baumgart's desired <br />it would only be setback 15' from the property line. <br />After looking at a sketch of the property Mr. Shearan said the garage <br />would only be 12' from the road and not less than 20' from the center <br />of the road. <br />Attorney Locher read from Ordinance 56, Sections 4.13, 4.14, 4.15 and 4.16; <br />which detail the setback regulations of the City of Lino Lakes. <br />Mr. Shearan, after reviewing the ordinance requirments moved to recommend <br />to the Council denial of this request under the circumstances. Mr. Nadeau <br />seconded the motion. Motion carried. <br />Mr. Nadeau asked about putting the garage in the back. Mr. Baumgart said <br />that it would take about 4 yards of fill to make it usable and he did not <br />feel that it would not be feasible for them to do this. <br />
