Special Council Meeting <br />June 30, 1980 <br />131 <br />I The Special meeting of the Lino Lakes City Council was called to order at <br />7:30 P.M? on June 30, 1980 with all members present. Mr. Schumacher was <br />also present. <br />The first item on the agenda was consideration of a special use permit <br />application by Mr. Robert Smeed for the keeping of horses on his land on <br />Ware Road. Mr. Smeed owns 2.6 acres and has leased land from two different <br />property owners to give him a total acreage of 5.5 acres. <br />Me. Schumacher presented the report from Mr. Kluegel. 1) the fence will <br />be moved to conform to ordinance - this has been done; 2) the waste will <br />be given to friend; 3) the pond did not have any odor and the septic is <br />over 40' from the pond and the septic system was pumped as maintenance; <br />4) no problme with teh drainage; 5) construct a wooden shelter under the <br />1000 square foot size. <br />A letter has been received from Mr. Arnold Kelling. The Clerk was asked <br />to read this letter. Mr. Al Ross had also requested to sepal, He read <br />a prepared statement objecting to this land use. <br />Mayor Gourley asked for comments from the Audience. A gentleman from the <br />audience wanted to discuss this with Mr. Ross. (Mr. Witham) Mayor Gourley <br />asked that the remarks be addressed to the Counci. <br />Mrs. Terry Smith felt there is room for both persons who wanted animals <br />and those who do not. <br />Mr. Suchy asked about his application and Mayor Gourley said he would <br />discuss this with him at the Council recess. <br />Mr. McGrath said he felt that Mr. Smeed had conformed to the Ordinance <br />requirements. <br />Mrs. Elsenpeter said she had several concerns - she pointed out the <br />Ordinance says that a person 'may' be issued a permit - it does not say <br />'shall'. She felt this is a residential area and that the homes are too <br />clsoe to have horses. She was also concerned about the leases not being <br />renewed and Mr. Smeed would have a lot of money invested in animals, <br />fences, shelter and she could forsee his asking to vary the five acres. <br />Mrs. Elsenpeter felt the parcel containing the five acres should be in <br />one parcel and controlled by the person requesting the special use permit. <br />not in several parcels of alnd subject to other decisions. <br />Mr. Smeed said the building and fence could be taken down and the horses <br />removed. He is well aware of the possibility this permit could be re- <br />voked in one year. <br />Mr. Kulaszewicz agreed with Mrs. Elsenpeter. He was also concerned about <br />the use of the shoulders of the road for riding - the ditches along there <br />are pretty deep. <br />Mr. Smeed said he is not planning on using the road. Mr. Kulaszewicz <br />asked about the pond and Mr. Smeed said when he had this dug it was for <br />a decorative purpose but it didn't turn out the way he and planned. Mr. <br />Smeed said ti was no big deal, he may have it filled. <br />
