1 <br />1 <br />1 <br />269 <br />April 8, 1974 <br />The regular meeting of the Lino Lakes City Council was called to order at 8:00 p.m. <br />by Mayor Bohjanen. Councilmen present; Jaworski, Marier, McLean. Absent; Zelinka. <br />Mr. Locher and Mr. Gotwald were also present. <br />Mr. Marier moved to approve the minutes as corrected. Seconded by M. Jaworski. <br />Motion carried. <br />The Clerk reported: <br />She had received notice of some tax forfeit land available - Lot 9, Block 2, <br />Lexington Park Lakeview addition. Mr. Marier moved to table this until April 22, <br />1974. Seconded by Mr. Jaworski. Motion carried. <br />Had received a letter from Mr. Askew dealing with the agreement between Anoka <br />County and Lino Lakes with reference to the Chain of Lakes Park Development. <br />Mr. Locher reported that he has a copy of the same letter and the map. On the map <br />they have included parcel 2 and the land area that was to be a golf course in the <br />Country Lakes area. He also has copies of the agreement signed by the Anoka County <br />Commissioners and need the signatures of the Council of Lino Lakes. <br />Mr. Marier asked if by signing this agreement, this legally binds the Board of <br />Commissioners? <br />Mr. Locher said it binds the Board of Commissioners and also this Council. He said <br />it represents a statement of intent and feels there is a moral responsibility on <br />future Boards and Councils to abide by this agreement. <br />Mr. Marier asked if this document was legal? Mr. Locher said, Yes, Mr. Marier <br />asked, if with the maximum of 2500 acres to be acquired by the County we discover <br />that more is being taken, do we challenge? <br />Mr. Locher said, Yes, but the burden of proof would be with the City. <br />Mr. McLean asked if the agreement meant that the 2500 acres are to be taken within <br />the boundaries as defined on the map? Mr. Locher said, Yes. Mr. McLean asked if we <br />compute what is being taken within this boundary and find that the acreage is too <br />much, then we challenge? Mr. Locher said, Yes. <br />Mr. Marier suggested having Mr. Gotwald make an overlay by which the total acreage <br />could be computed. He so moved. Seconded by Mr. Jaworski. Motion carried. <br />Mr. Gotwald said he would first check with the County. Mr. Marier asked the Clerk <br />to make note in the minutes of the fact that Mr. Gotwald has the copy of Exhibit <br />"A". <br />Mr. Mclean moved to ratify the agreement as presented and authorize signatures of <br />the Mayor and Clerk. Seconded by Mr. Jaworski. Motion carried. <br />The Clerk read a letter from the County Attorney: announcing a hearing on the <br />condemnation of certain parcels of land. The only interest of the City lies in the <br />special assessments and unpaid taxes. Mr. Locher asked if he should attend this <br />meeting. Mr. McLean moved to authorize Mr. Locher to attend the hearing. Seconded <br />by Mr. Jaworski. Motion carried. <br />
