MINUTES <br />REGULAR CITY COUNCIL MEETING ~, <br />MARCH 14, 1984 <br />PAGE 2 <br />Fiscal Consultant Chenoweth presented proposed Resolution 84-9 calling for BOND SALE <br />the sale of bonds in the amount of $1,075,000.00 for the refunding of the SCHEDULING <br />temporary improvement bonds and other projects, and reviewed the sale <br />details. The recommended date of sale is April 25, 1984 at 7:30 P.M., <br />allowing the Bond Attorney to review the resolution and complete all legal <br />matters. Mayor Eggert moved, seconded by Councilmember Baldwin, that <br />Resolution 84-9 be approved. Motion carried unanimously. <br />RESOLUTION 84-9 RESOLUTION <br />84-9 <br />RESOLUTION PROVIDING FOR PUBLIC SALE OF $1,075,000.00 <br />GENERAL OBLIGATION TAX INCREMENT IMPROVEMENT BONDS OF <br />1984 <br />Mayor Eggert presented a letter from Beverly Higgins, 1335 W. Iowa, BEVERLY <br />requesting that the City reimburse her in the amount of $351.25 for HIGGINS, 1335 <br />costs incurred by a sewer back up. Council discussed the matter with W. IOWA <br />Mrs. Higgins after which Councilmember Baldwin moved, seconded by REQUEST~FOR <br />Councilmember Chestovich, that the request be granted. Council- REIMBURSEMENT <br />member Ciernia felt the City should establish a fund to assist ON SEWER BACK <br />residents when this sort of problem occurs as at present there is UP - DEFERRED <br />no Council policy, each case is handled differently. After a TO 3/28/84 <br />thorough discussion, Councilmembers Baldwin and Chestovich withdrew <br />the motion and Council directed the City Attorney to draft a policy <br />to be presented at the next meeting for consideration. The City <br />Engineer was then directed to investigate the matter in an attempt <br />to determine why Mrs. Higgins has the recurring problem. <br />Fire Chief Renchin addressed the matter of the proposed Appendix E APP,~ENDIX E <br />and explained that Pat Coughlin, Fire Chief of Richfield, who served ADOPTED <br />on the code board, was in attendance to answer questions. In reply <br />to a question from Mayor Eggert, Mr. Coughlin replied that 12 <br />communities in the Metropolitan area have adopted Appendix E, and <br />that it must be adopted as is, cannot be altered. It was explained <br />that there are some trade-offs in installing sprinkler systems, and <br />savings can be made in other areas such as reduction in wall <br />density, etc. Attorney Jim Page, representing the apartment owners, <br />George Berry and Jim Boyd, asked if changing from apartment to condo- <br />minium would constitute a change in occupancy. Mr. Coughlin replied <br />that it would not, however, an addition to the building of 2,000 square <br />feet or more could require sprinkling the entire building. The City <br />Building Inspector would determine change of occupancy classification and <br />all other matters pertaining to the code enforcement. The code also makes <br />the Council a board of appeals in the event the Inspector's determination <br />is questioned. Following the discussion, Councilmember Hard moved, <br />seconded by Mayor Eggert, that Ordinance ~1~203 be adopted and that the <br />Clerk Administrator be authorized to publish the same.
