MINUTES <br />REGULAR CITY COUNCIL MEETING ~ ~ <br />JULY 11, 1984 <br />PAGE 3 <br />RESOLUTION 84-21 RESOLUTION <br />84-21 <br />RESOLUTION FORMING DEVELOPMENT DISTRICT N0. 2, <br />ADOPTING DEVELOPMENT PROGRAM, DECLARING PUBLIC <br />PURPOSE, AND PROVIDING FOR ADMINISTRATION <br />Acting Mayor Chestovich opened the Public Hearing on Zoning Ordinance and Map <br />at 8:00 P.M, and presented the 9ffidavit of Publication. PUBLIC HEARIN( <br />ON ZONING MAP <br />Attorney Gasteazoro reviewed the action taken by the Planning Commission at AND ORDINANCE <br />their Public Hearing on June 28, and explained the intent of the Commission 8:00 P.M. <br />regarding the Existing Business District designation (EB). The intent is <br />that land zoned EB could continue to function as in a B-2 district and the <br />property could be sold to anyone who wished to use the land for B-2 purposes. <br />It was not intended to downgrade the use of the property. To alleviate <br />misunderstanding, Attorney Gasteazoro recommended by Subdivision 3a on Page <br />213 be corrected to read as follows: Conditional Uses - Any change in business, <br />any structural alterations, any change, expansion or intensification of <br />structural or land use as permitted in B-Z classification and regulated therein. <br />Attorney Gasteazoro drew to Council's attention discrepancies in the "lighting" <br />sections on pages 241 and 231 and recommended that both read "in no case shall <br />Lighting exceed two foot candles in a business zone nor 0.5 candle in a <br />residential zone". <br />Claude Schuttey representing the University of Minnesota, stated that the CLAUDE <br />University objects to the R-1 overlay on University property and would like SCHUTTEY <br />it to remain as it is at present: P-1. It was explained to Mr. Schuttey thatU OF M <br />the R-1 only applies if the land is sold. Mr. Schuttey stated he <br />wished to go on record as objecting. <br />Robert Moder, owner of the property at 2061 W. Larpenteur, requested that ROBERT MODER <br />Council not rezone his property from B-lA to B-1 as he has mortgage committ- 2061 W. <br />ments at this time and with a change in zoning that might change. Mr. Moder LARPENTEUR <br />stated that he hopes to go ahead with his present plans for an office <br />condominium on the site. Following a discussion, Acting Mayor Chestovich <br />moved, seconded by Councilmember Ciernia, that the Moder property remain <br />B-lA. Motion carried unanimously. <br />Don Mead, Planning Commission Member, explained that the Commission's reason DON MEAD <br />for the rezoning was to have the area south of Falcon Woods and west of Prior <br />zoned the same - B-l. There being no others wishing to be heard, Acting Mayor <br />Chestovich closed the hearing at 8:52 P.M. HEARING CLOSEI <br />Councilmember Ciernia moved, seconded by Acting Mayor Chestovich, that <br />Ordinance ~~205 be adopted with the modifications recommended previously <br />and that publication of a summary be authorized.
