MINUTES <br />REGULAR CITY COUNCIL MEETING <br />FEBRUARY 11, 1981 <br />PAGE 2 <br />Councilmember Steele moved, seconded by Councilmember Eggert, that <br />Supplemental Agreement 463 be denied as it is the result of a staking <br />error by the County. Motion carried unanimously. <br />Mayor Warkentien moved, seconded by Councilmember Eggert, that <br />Supplemental Agreement 462, decreasing the contract price in the amount <br />of $346.62, be accepted. Motion carried unanimously. <br />Fire Department Members Joseph Bianchi and Craig Schauffert were in <br />attendance to present the Fire Department Relief Association's proposed <br />by-law amendment. Following the discussion Councilmember Eggert moved, <br />seconded by Councilmember Brown, that the by-law amendment be approved <br />with the first sentence amended to read as follows: "Upon Fireman's <br />death, in or out of the line of duty, the surviving spouse receives the <br />amount of pension due at that time, or in payments acceptable to the <br />surviving spouse and the Association, according to the vested rights of <br />the fireman as of the date of death." Motion carried unanimously. <br />Mayor Warkentien presented for Council's approval a request from the <br />Fire Department to extend the term of duty of Joseph Bianchi and Donald <br />Pantzar. Councilmember Eggert moved, seconded by Councilmember Brown, <br />that Council authorize the extension of the term of duty of Firemen <br />Bianchi and Pantzar with a maximum retirement age of 65 years, or re- <br />tirement by choice, disability or death. Motion carried unanimously. <br />Councilmember Brown moved, seconded by Councilmember Larson, that <br />Fire Department Applicant David Pearson, 1192 Garden Avenue, be <br />approved subject to the required physical and the one year probation <br />period. Motion carried unanimously. <br />Attorney Allen reported that he had reviewed some of the criminal ord- <br />inances including the Parks Ordinance and Nuisance Ordinance 4620, as <br />requested by Council at the January 28, 1981 meeting, and presented for <br />Council's consideration a proposed ordinance adopting a criminal code <br />for the City of Falcon Heights. Following a lenghty discussion Council <br />concurred that before taking any final action, a copy of the proposed <br />ordinance be sent to the City's Prosecuting Attorney for his review <br />and comments. <br />Discussion of the proposed Swimming Pool Ordinance was deferred in order <br />that Councilmember Larson might review the previous action by the Plan- <br />ning Commission. <br />Attorney Allen presented proposed Ordinance X178 relating to the Build- <br />ing Code and fees for the City. Councilmember Eggert moved, seconded <br />by Councilmember Larson, that the Ordinance X178 be adopted as presented <br />by the Attorney.
