Engineer <br />Lemberg explained that the state aid funds are being used for paying <br />that balance which is not assessed. Councilmember Eggert stated that <br />it actually reduced the original projected cost because the state aid <br />funds amounted to more than the storm sewer and if state aid funds are <br />used, a storm sewer was required. Therefore, the total assessment at <br />this time is less than the total original projected assessment as <br />the original amount without state aid funds would have been $167,000 but <br />by utilizing the state aid funds it brings the cost down ~2~.,000. Mr. <br />Anderson said he did not derive any benefit from Pascal being improved <br />because his garage comes off Arona and he does not use the alley. For <br />that reason he felt the apartments, commercial buildings and other <br />residential homes west of tirona should be participating in the project. <br />Councilmember Eggert stated that at the last public hearing he asked why <br />streets on which houses do not front should not be assessed to everyone <br />and was told that the City was divided up and benefit had to be shown in <br />order t o justify the assessment legally and, therefore, assessments must <br />be limited to the benefitted quadrant. He felt Mr. Anderson brought up <br />a valid point as he felt sure the whole quadrant uses the streets. He <br />felt there was no reason not to assess the whole quadrant and asked how <br />other Councilmembers felt. <br />Councilmember Ciernia said that he recalled asking the attorney what the <br />legal basis is for making an assessment. There were several different <br />ways--citywide, quadrant wide levies and assessment of benefitting <br />properties and the attorney stated that they would have to be able to <br />meet the test of benefitting property by the amount of the assessment. <br />The question is, do the people living on Snelling Drive benefit from an <br />improvement on Albert. This would be difficult as they do not benefit <br />nearly as much as someone living on Iowa between Pascal and Albert. <br />1.35 <br />DAVE ANDERSON <br />1512 W. IDAHO <br />(continued) <br />COUNCILMEMBER <br />EGGERT <br />COUNCILMEMBER <br />CIERNIA <br />Fiscal Consultant Chenoweth commented he is getting benefit but someone FISCAL <br />on Arona who does not have to go into the alley and get out on Albert or CONSULTANT <br />Pascal does not have that benefit. Everyone in the community benefits some CHENOWETH <br />but there is a more direct benefit to those living nearby. He felt if <br />properties west of Arona are assessed it would be very difficult to <br />make that assessment stick. <br />Councilmember Ciernia pointed out that it is a fair statement that the <br />entire City benefits from improvement of the roads but you lose sight <br />of the fact that about !~0 percent of the total cost is covered by public <br />funds that are available to the City for street maintenance which is a <br />significant amount of money. Therefore, there is recognition that there <br />is a general City benefit up to 1~0 percent of the total project. <br />Bob Olson, 1386 W.
