Councilmember Larson stated that 1362 W. <br />Hamline will be redone sometime in 1983 and the alley drainage should LARPENTEUR <br />be corrected because Hamline will be lowered. Engineer Lemberg advised <br />that the storm water from the alley would be draining toward California <br />after the storm sewer is installed and the alley situation should be <br />improved. <br />Mrs. Sturm, 1129 W. Hoyt, asked what kind of benefit the people on Eoyt MRS. STURM, <br />will be receiving to which Engineer Lemberg replied that people who 1Lt29 W. HOYT <br />have garages or. the alley would benefit. <br />Fran Johnson, 1l~25 W. Hoyt, stated she had no benefit from the streets FRAN JOHNSON <br />because her driveway goes to Hoyt and she never uses the alley for any 1lt25 W. HOYT <br />reason. She also stated she is on affixed income and does not benefit <br />to which Clerk Administrator Barnes replied that she could get an <br />attorney and appeal the assessment. <br />Ken Johnson, son of Fran Johnson, 1.25 W. Hoyt, asked if there was an KEN JOHNSON, <br />engineering report showing the benefit to each individual lot. Mayor SON OF FRAN <br />b~farkentien advised that it is done by area and Engineer Lemberg advised that JOHNSON, <br />study was donez-rior to the l~iarch hearing and is available at the Clerk's 1l~25 W. HOYT <br />Office. Mr. Johnson said he was providing a sign-up sheet for everyone who <br />is interested in a class action litigation suit against the Council for <br />failure to provide adequate show of benefit for each lot. A discussion <br />ensued regarding whether or not residents must have an attorney in order <br />to appeal the assessment and Clerk Administrator Barnes reminded that there <br />is a 30 day appeal period from the date of the October 5th hearing. <br />Mrs. Dobin, 1362 W. Larpenteur, asked what could be done for the alley MRS. DOBIN, <br />drainage and if it was necessary to petition for alley improvement. 1362 W. <br />Engineer Lemberg again stated that water will no longer run off Albert LARPENTEUR <br />into the alley so drainage in the alley should improve. <br />Mayor Warkentien closed the public hearing at 9:55 P.M. PUBLIC HEARW <br />CLOSED AT <br />Councilmember Eggert made a metion that the City Council drop the 9:55 P.M. <br />present assessment plan and in its place consider assessing the <br />minimum required amount to the benefitted property. Motion died for MOTION TO <br />lack of a second. DROP PRESENT <br />ASSESSMENT <br />Mayor Warkentien moved, seconded by Councilmember Larson, that PLAN DIES <br />Resolution 82-1~7 be adopted approving the assessment roll as prepared. FOR LACK OF <br />jipon a vote being taken the following voted in favor thereof: Mayor SECOND <br />Warkentien, Councilmembers Larson and Ciernia, and the following voted <br />against the same: Councilmember Eggert.
