Page 2 <br />MINUTES ~ 2 <br />REGULAR CITX CQUNCIL MEETING <br />MARCH 8, 1978 <br />Clerk Administrator Barnes made note of the letter PAT KELLEY <br />written to Council on Feb. 13, 1978 by Mrs. Patrick 1402 West <br />Kelley, 1402 W. Larpenteur and also appeared before Larpenteur <br />council on the 22nd of Feb., 1978. It was explained <br />to Council that the city sewer had been blocked and <br />did back up into the basement of the Kelley residence. <br />Mr. Patrick Kelley appeared before council to discuss <br />policy in handling this type of problem should it <br />come up again in another area, due to the city policy <br />as it stands now. Councilman Steele moved, seconded <br />by Councilman McGough to authorizing Clerk Administrator <br />Barnes to determine action to be taken on an individual <br />basis in order to give citizens a more positive feeling <br />of action being taken. Upon a vote being taken the <br />following voted "aye": Mayor Warkentien, Councilmembers <br />Black, McGough Steele and Brown and the following voted <br />"nay": None. Motion carried.. <br />Atty.VanDeNorth noted to council if it is subsequently <br />determinded the blockage is in the city sewer lines, the <br />City's insurance in all likelyhood would cover any damage <br />that may occur, if the City was liable. If the insurance <br />company does not cover damages, the city council on its <br />own motion may pick up the cost of the damages after re- <br />viewing each case on an individual basis. Atty. VanDeNorth <br />suggested that is the type of policy the city should have. <br />Mrs. Hazel Richards, 1700 N. Fry appeared before Council MRS. HAZEL <br />concerning the use of her driveway as a turn-around point RICHARDS <br />on Fry Street by cars and trucks and feels very nervous 1700 N. FRY <br />as this continues day and night. The Sheriff Deputy <br />suggested she bring the matter before council. Council <br />discussed with Mrs. Richards the probable cause being as <br />there is not a median cut on Larpenteur for the apartment <br />across the street, the apartment tenants can not reach <br />the parking lot going east on Larpenteur, so are required <br />to turn in on Fry, turn around and head west on Larpenteur <br />for the 280' needed to reach the parking lot. Councilman <br />Steele suggested to Councilman McGough he look into .the she riff <br />dept.'s suggestion of signs and which deputy had talked <br />with Mrs. Richards. A sign can be erected, however, it <br />was felt by council this would not solve her problem. <br />Council will request the county to put in a median cut <br />280' west of Larpenteur and Fry to permit access to the <br />apartment parking lot. Also, council requested Clerk <br />Administrator Barnes to check into the parking lot pro- <br />visions for Buck's Unpainted Furniture in respect to the <br />screening adjacent to the residential area. <br />ii <br />
