Clerk Administrator Barnes informed Council a letter <br />of appreciation had been sent in their behalf and that the Council <br />would use the funds for park equipment. <br />Councilmember McGough briefed Council on the damaged storm sewer FULHAI~/FOLWELL <br />at Fulham and Folwell. The storm sewer starts i.n Falcon Heights b'TOItM SEWEEt <br />and ends in Lauderdale, Mr. S~nith~s property abuts the end of <br />the sewer. line, but Lauderdale apparently does not have an ease- <br />ment to the groperty. Th have surrendered the easement, which <br />means we can not go in a"epair the storm sewer without his per- <br />mission, even thongb the lice begins in Falcon Heights. Last spring <br />Mr. 5mi.th threatened to sue Falcon Heights and Lauderdale for <br />water damage because of the break in the line, however, he refuses <br />to allow atayone on his groperty. Councilmember McGough suggested <br />we contact Lauderdale and inform them we will repair the line if <br />they can obtain a germanent easement from him at their expense. <br />Part of the problem suns from the removal of a pine tree. The <br />tree that would have to be removed does not belong to him, nor is <br />it on his property. He states the tree has sentimental value as <br />it was planted by a neighbor boy now deceased. Council directed <br />Attorney Kenefick to contact John Dean, Lauderdale City Attorney, <br />and come up with a workable solution. <br />Eng~.neer Lemberg reported he had met with Clerk Administrator HFkILITT PACKARD <br />Barnes and Mr. Fred Harvey, Facilities Manager of Hewl.itt- Packard. <br />They are going to provide a complete layout of the land, showing <br />parking lots, etc. There will have to be rezoning for that area <br />as they are purchasing parts of tracts which are zoned differently. <br />lhey will return in two weeks with a complete layout for consideration. <br />Bngizteer Lemberg reported he had talked with Mr. & Mrs. Steven ROSELAWN <br />Brandt, 1592 Roselawn Avenue, regarding the temporary easement re- EASEMENT - <br />quired for the bike/walkway. They have stated they do not want BRANDY PROPERTY <br />the bike/walkway on Roselawn. They were afraid their property would <br />go down in valu®. It is possible to change the grade and sloping <br />and not touch their property at all, iF the City would like to <br />continue with the bike/walkway plans proposed in the upgrading of <br />Roselawn Avenue. <br />Engineer Lemberg stated he had given Clerk Administrator Barnes a ZONING MAPS <br />draft copy of the zoning maps. Printing of the maps will be held <br />pending possible changes is zoning in regard to the Haiwlitt-Packard <br />proposal and suggestions by the City Planning Consultant. Copies <br />of the zoning maps will be made available for the Planning Commis- <br />ion~s use. <br />Councilmeaaber McGough reported that $110,000 had been budgeted for TREE PROGRAM <br />the Tree Program in 1977, we spent $511, 7611.011. Clerk Administrator MONEY ~i'NT <br />Barnes applied to the State for reimbursement and received a check <br />in the amount of $8,593.56, leaving a balance of $1a5,520.1~8 spent <br />in the 197? program, which was still over the budget. <br />Councilmemlber McGough stated he had talked with Phil & Gloria Meyer, TATUM STREET <br />who purchased the Labalestra home at Larpenteur and Tatum.
