S? Minutes July 22, 1976 Page Three The request of Charles H. Soderberg to construct a !~0 foot Ham-radio transmitting tower on his property of the above mentioned address was previously considered at a regular Counsdl meeting of June 2l~, 1976 at which time Council requested the City Attorney to review Zoning Ordinance #~1 and other Jurisdictional opin?ons furnished by Mr. Soderberg, to determine whether City Ordinance #61~ permitted such construction, was reviewed by Councilman Black and Attorney Kenefick. Councilman Black reminded Council that the Planning Commission recommended denial of the request. Attorney Kenefick related it would be an accessary structure and therefore requires a Conditional Use Permit under Ordinance #6!~ relative to R-1 districts, and a Variance would be required if Mr. Soderberg wanted to exceed the 25 foot height. Motion by Councilman Black to deny the Conditional Use request of Charles H. Soderberg of 1152 W. Idaho to construct a !l0 foot transmitting tower on his property. Motion died for lack of a second. Motion by Councilman Ecklund, seconded by Councilman Labalestra to table Mr. Sederberg's request until the Planning Commission reviews the City Attorneys opinion in respect to other Jurisdictional Ordinances and various other opinions which Attorney Kenefick rendered, requesting the Planning Commission to propose a new ordinance regulating the use of radio towers or an amendment to the existing ordinance or do nothing. Upon a vote being taken the following voted "aye": Councilmen Ecklund and Labalestra, and the following voted "nay": Mayor Warkentien, and Councilman B]a ck. Motion failed. Motion by Councilman Labalestra, seconded by Councilman Ecklund to table the request until a full council was present to further discuss the request on August 25, 1976. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, and Labalestra, and the following voted "nay": None. Motion carried. Moved by Councilman Labalestra, seconded by request of Marvin Satilinek of 1?~53 West Io~ in the cost of the repair of his private Sa letter be sent to him explaining the policy Upon a vote being taken the following voted Councilmen Black, Ecklund, and Labalestra, , None. Motion carried. Councilman Black to deny the MARVIN KATILINEK 'a, requesting the City to share SEWER REPAIR ataxy Sewer line and that a COST REQUEST of the City on such repairs. SEWER Engineering Firm requesting Council to go on record to televise all future CONSTRUCTION Public Sanitary Sewer installations in the City of Falcon Heights. TELEQISING Motion by Mayor Warkentien, seconded by Councilman Ecklund to adopt the recommendation to televise all future Sanitary Sewer installations in the City of Falcon Heights. Upon a vote being taken the following voted "ayen; Mayor Warkentien, Councilmen Black, Ecklund, and Labalestra, and the following voted "nay": None. Motion carried.
