9~ <br />Mr. Gene Struble, 1725 St. Marys Avenue, representing Mr. <br />and Mrs. John Struble, 1850 Snelling Drive, and Mr. <br />Richard Elhardt, 18L~1 Asbury Avenue, were present. Mr. <br />Elhardt sated that he had checked with his attorney <br />and that the attorney had checked into the title for <br />the property and that he could not find any restrictive <br />covenant on that piece of property. Mr. Struble said <br />that no agreement has been reached concerning this <br />building, and that Mr. and Mrs. John Struble are now <br />prepared to take legal action concerning the matter, <br />and also suggested that the Village Council not become <br />involved until some clarification and determination <br />has been made. <br />Councilman Ecklund moved, seconded by Councilman Stone, <br />that the matter be tabled. Motion carried. <br />Mr. Warren Johnson of 1lt80 W. Iowa Avenue, was present SEWER PROBLEM - JOHNSON <br />to discuss the problem he has been having with his 1l~80 W. IOWA <br />sewer system at the above address. He stated that <br />he has been in contact with the Village regarding this <br />problem since October of 1969, and that it has been <br />checked by the Village Maintenance Department. <br />Councilman Stone moved, seconded by Councilwoman Stocker, <br />that the sewer be dug up next spring if it malfunctions <br />this winter, and cost determination will be made under <br />the old policy. Motion carried. <br />Councilman Stone introduced the following Resolution FINAL PAYMENT TO T. A. <br />and moved its adoption: SCHIFSKY & SONS - 1973 <br />SEALCOATI NG PROJECT <br />RESOLUTION 73-32 <br />A RESOLUTION APPROVING THE FINAL PAYMENT TO T. A. <br />SCHIFSKY AND SONS FOR THE 1973 SEALCOATING PROJECT <br />IN THE AMOUNT OF $606.03 <br />Councilman Ecklund seconded the foregoing Resolution, <br />and upon a vote being taken thereon, the following <br />voted in favor thereof: Mayor Warkentien, Councilmen <br />Black, Ecklund, and Stone, and Councilwoman Stocker, <br />and the following voted against the same: None. <br />Motion unanimously carried. <br />Councilman Ecklund introduced the following Resolution RESOLUTION APPROVING MINUTES <br />and moved its adoption: OF CANVASSING BOARD <br />RESOLUTION 73-33 <br />A RESOLUTION APPROVING THE MINUTES OF THE CANVASSING <br />BOARD MEETING OF DECEMBER 6, 1973, DECLARING THE <br />FOLIAWING ELECTED TO OFFICE: WILLIS C. A. WARKENTIEN, <br />MAYOR; GENE STEELE & LU STOCI~R, COUNCILMEMBERS; <br />RONALD J. RIACH, JUSTICE OF THE PEACE <br />Councilman Stone seconded the foregoing Resolution and <br />upon a vote being taken thereon, the following voted <br />in favor thereof: Mayor Warkentien, Councilmen Black, <br />Ecklund, and Stone, and Councilwoman Stocker and the <br />following voted against the same: None.
