DELETING PART C AT THIS TIME, AS PER THE RECOMMENDATION OF THE CITY ENGINEER Councilwoman Stocker seconded the foregoing Resolution, and upon a vote being taken thereon, the follokd.ng voted in favor thereof: Mayor Warkentien, Councilmen Black, Ecklund, and Steele, and Councilwoman Stocker. Motion unanimously carried. /"~ U Councilwoman Stocker moved, seconded by Councilman Black, that the Council approve the request of A11an Law, 2717 Stevens Avenue, Sotath, Minneapoils, who is requesting that the Minneapolis Recreation Development organization be allowed to sell candy in the City of Falcon Heights, the proceeds to be used for recreational activities for under privileged children. Upon a vote being taken thereon, the following voted in favor thereof: Mayor Warkentien, Councilman Black, and Councilwoman Stocker, and the following voted against the same: Councilman Steele. Councilman Ecklund abstained. Motion carried. Mr. Keith Hofeld, owner of the K & K Hardware, which will be occupying the building formerly leased by Krause's Bakery, was present to request a conditional use to utilize the existing protruding sign on th e front of the building. They will also be using the existing signs on the front of the building, but will just be changing the plastic facing. It was the City Attorney's opinion that this sign was a prior non-conforming use, therefore, no action was taken. Clerk-Administrator Barnes reported on the meeting held at White Bear Lake, on May 10, 197t~, in regards to the Ramsey County Proposal to establish a joint powers for tree chipping operations, and recommended that the Council not commit the City to said proposal. He also stated that he has written to the State Agricultural Department regarding the passage of legislation re- quiring each community to adopt a tree maintenance program. A copy of the Falcon Heights ordinance and tree maintenance program has been submitted to the State Department for their review to determine if th e City's existing aid and program do comply S,ii.th the law. 44 REQUEST BY MINNEAPOLIS RECREATIONAL DEVELOPMENT PROGRAM CONDITIONAL USE REQUEST K & K HARDWARE - 1535 W.
