Motion was carried. <br />Proposed Apartment Ken Nordby of Northwest Design Inc, 1061 Rice Street, <br />Building - 1800 and James Boyd, owner of .property at 1800 West harpenteur, <br />West Larpenteurs presented conditional use and variance applications for <br />a thirty-six unit apartment which is in a 5-~1A District. <br />Af ter review, Black moved, seconded by Strandquist that <br />the following resolution be adopted. <br />WHEREAS, James H. Boyd, Jr. has made application <br />to the Village of Falcon Heights for (1) a conditional use <br />permit to construct a 36 unit apartment building at 1800 <br />West Larpenteur Avenue, which property at the present time <br />is zoned B-~.A, and pursuant to Ordinance No. 6t~ as <br />as amended by Ordinance No. 71, a conditional use permit <br />is required for the construction of an apartment building <br />in a Bl A district, and (2) a variance permit for a side <br />lot setback of ten (10) feet instead of the required <br />twenty (20) feet, and (3) a variance with respect to roof <br />elevation,.and <br />WHEREAS, the Village of Falcon Heights has referred <br />said requests for conditional .use permit and variance <br />permits to the Planning Commission of the Village of <br />Falcon Heights, and said Planning Commission has approved <br />said conditional use permit and variance requests by a <br />report dated March 28, 1968, a copy of which is on file <br />in the Clerkts office and incorporated herein by reference,, <br />and _ <br />WHF,REAS, the Village Council of the Village of Falcon <br />Heights has reviewed the request for variance permits and <br />conditional use permits, has reviewed the report of the <br />Planning Commission, and has conferred and consulted with <br />said applicant personally <br />NOV1, THEREFORE, BE IT RESOLVED by the Falcon Heights <br />Village Council that <br />1. The Village of Falcon Heights finds that there are <br />practical difficulties and particular hardships in the <br />carrying out to the strict letter of the regulations of <br />this ordinance, and that the granting of the variances <br />requested does not apply generally to other land or <br />structures in the district in which said land is located, <br />and that the granting of said application is necessary for <br />the preservation and enjoyment of a substantial property <br />right of the applicant, and that the granting of the <br />proposed variance tivill not impair an adequate supply of <br />light and air to adjacent property, unreasonably increase <br />the congestion in the public streets, increase the danger of <br />fire, endanger the public safety, unreasonably diminish or <br />impair established property values in the surrounding area, <br />or in any other way impair health, safety, comforts, morals <br />' or in any other respect be contrary to the intent of <br />Ordinance No. 6!~ or the comprehensive plan of said village. <br />
